Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota, was held on the 7th day of

Counr_ilmember Neils introduced the following Resolution and moved

RESOLUTION NO. 81-401
APPROVING RPUD PRELIMINARY PLAT/PLAN AND CONDITIONAL USE PERMIT AND REGARDING
REZONING FOR LOWRY HILLS CONSTRUCTION COMPANY FOR "DEERHAVEN" RPUD 81-4 (81011)
WHEREAS, Lowry Hills Construction Company has requested approval of an RPUD
Preliminary Plat/Plan, Conditional Use Permit and Rezoning for "Deerhaven"
consisting of 52 units at the southwest corner of Zachary Lane and County Road 10;
and,
WHEREAS, the Planning Commission has reviewed the request at. a duly called public
hearing and has recommended approval;
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request of Lowry Hills
Construction Company for RPUD Preliminary Plat/Plan and Conditional Use Permit for
"Deerhaven" at the southwest corner of County Road 10 and Zachary Lane subject to
the following conditions:
1. Compliance with the City Engineer's Memorandum for this project.
2. Alternate 'A' to be utilized for buildings 1 and 5.
3. Removal of all dead or dying trees from the property at the
owner's expense.
4. No building permits shall be issued until municipal sewer
and water are physically available to the sites.
5. Rezoning shall be finalized with filing of the final plat.
6. Street names and numbers shall comply with the City's street
naming system.
7. No building permits shall be issued until the final plat
is filed and recorded with Hennepin County,
8. Compliance with Policy Resolution number 79-80 regarding
developments adjacent to, or containing storm water holding
facilities.

9. Homeowner Association documents and covenants shall be
reviewed and approved by the City Attorney.
10. The 30 foot wide trail corridor shall be provided as
an easement along Zachary Lane. The Park Director
and City Manager shall negotiate with the developer to
determine a possible exchange of the marsh area and/or
the high knoll area, for an equitable settlement of the
dedication fee requirement.
11. Grading for the trail shall be done with the plat grading
and the surfacing of the trail shall be completed prior
to issuance of building permits for Lots 11, 12 and 13.
12. The Final Plat shall include a one foot wide outlot along
the west boundary of the plat.
