HomeMy WebLinkAboutCity Council Resolution 1981-400CITY OF PLYNDM Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on t e 7th day of July , 19 81. The following meabers were present: aye or llavenport, -C9WncJ members Hoyt, Neils, Schneider and Threinen were aaa Councilmember Threinen introduced the following Resolution and moved its tion: RESOLUTION NO. 81-400 APPROVING PRELIMINARY PLAT/PLAN, CONDITIONAL USE PERMIT AND REGARDING REZONING FOR "MISSION HILLS PARK 8TH ADDITION" FOR MINNESOTA HOMES RPUD 81-3 (80027) WHEREAS, Minnesota Homes has requested approval of an RPUD Preliminary Plat/ Plan, Conditional Use Permit, and Rezoning for "Mission Hills Park 8th Addition" consisting of 33 single family detached homes south of County Road 9 and approximately 300 feet west of Zachary Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and has recommended approval; NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the RPUD Preliminary Plat/Plan and Conditional use Permit for "Mission Hills Park 8th Addition" for Minnesota Homes subject to the following conditions: 1. Compliance with the Engineer's Memorandum for this project. 2. Final plat submission shall include detailed grading, berming and landscaping plans for the area along the south side of County Road 9 and designs for the pond and open spaces. 3. The rezoning shall be finalized with the final plat. 4. All dead or diseased trees shall be removed at the developer's expense. 5. No building permit shall be issued until utilities are physically 1 available to the site. 6. Dedication of 30 foot wide outlot for trail purposes and payment of fees -in -lieu of dedication prior to filing final plat per Council Dedication Policy then in effect. 7. Compiance with RPUD requirements in Section 9 of the Zoning Ordinance for final plat approval. 8. Allowance of 30 foot front yard setbacks so as to be consistent throughout the Mission Development. The City will participate in the cost of jacking the water line under County Road 9 and will pursue Hennepin County participation in the costs for the widening of County Road 9. Participation in the incremental cost of jacking versus open cut crossing of County Road 9 is judged to be reasonable in this particular case because of the unusual number of utility extensions required to serve abutting properties. The motion for the adoption of the foregoing Resolution was duly seconded by Copncilmamb r Hoyt , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Counci lmembers Hoyt, aj- zujuvwxng vuLm against or acstained: none Whereupon the Resolution was declared duly passe adopted.
