Councilmember Schneider introduced the following Resolution and moved

RESOLUTION NO. 81-376
APPROVING VARIANCE FROM THE SUBDIVISION ORDINANCE REGULATIONS IN SECTION
500.41 TO PERMIT A DIVISION OF UNPLATTED LAND CREATING TWO LOTS SOUTHWEST
OF 3RD AVENUE NORTH AND LUCE LINE TRAIL FOR MR. jESS PROBASCO (81022)
WHEREAS, Jess Probasco has requested a variance from the Subdivision Regulations
in Section 500.41 of the Subdivision Ordinance to allow creation of two lots
on unplatted land southwest of 3rd Avenue North and Luce Line Trail Intersection
in the Southwest Quarter of Section 31; and,
WHEREAS, the Planning Commission has reviewed said request End has recommended
approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLY-
MOUTH, MINNESOTA, that it should and hereby does approve the variance from
the Subdivision Regulations in Section 500.41 of the Subdivision Ordinance
to allow the property division creating two lots southwest of 3rd Avenue North
and Luce Line Trail intersection in the southwest quarter of Section 31 as
follows:
EXISTING LEGAL DESCRIPTION
That part of the West 334.75 feet of the Eost 604.25 feet of the Southeast 1/4
of the Southeast 1/4 lying northerly of Railroad right-of-way in Section 31,
Township 118, North Range 22, West of the 5th Principal Meridian.
To be divided into two new parcels as follows:
PARCEL A: That part of the West 110 feet of the E6st 604.25 feet of the
Southwest quarter of the Southeast quarter of Section 31, Township 118, North,
Range 22 West of the 5th Principal Meridian, lying North of the Luce Line
Trail (formerly the Electric Short Line or Minnesota Western Railway).

PARCEL B: That part of the West 224.75 feet of the East 494.25 feet of
the Southeast quarter of Section 31, Township 118 North, Range 22 West
of the 5th Principal Meridian, lying North of the Luce Line Trail (formerly
the Electric Short Line or Minnesota Western Railway).
FURTHER, that the City Manager be authorized to make the necessary special
assessment corrections based upon City policy when the division is approved
by Hennepin County.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilmember Threinen , and upon vote being taken thereon, the
following voted in favor thereof: Acting Mayor Hoyt, Councilmembers
Schneider and Threinen
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
