Minnesota, was held on We 15th day of June , 19_j_. The following members were present: Mayor Davenaort, Councimembers Hoyt, Schneider and Threinen owing members were absen Cogncilmember Hoyt introduced the following Resolution and moved is adoption: RESOLUTION NO. 81-370 APPROVING PRELIMINARY PLAT, PRELIMINARY PLAN, CONDITIONAL USE PERMIT AND REGARDING REZONING FOR B -T LAND COMPANY FOR "WEST MEDICINE LAKE TERRACE" RPUD LOCATED GENERALLY NORTHEAST OF WEST MEDICINE LAKE DRIVE AND COUNTY ROAD 9 (80008) WHEREAS, B -T Land Company has requested approval to rezone 40.0 acres from FRD (future restricted development) District to corresponding urban districts for the LA -1 and LA -2 guiding classifications, and a conditional use permit, preliminary plan, and preliminary plat for a residential planned unit develop- ment of 36 single family detached units and 72 attached units northeast of West Medicine Lake Drive and County Road 9; and, WHEREAS, the Planning Commission has considered the request following a duly called public hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLY- MOUTH, MINNESOTA, that it should and hereby does approve a preliminary plat, conditional use permit and preliminary plan of "West Medicine Lake Terrace" RPUD for B -T Land Company subject to the following conditions: 1. Compliance with the City Engineer's Memorandum 2. Removal of all dead or dying trees from the property at the owner's expense. 3. Staging of the development shall be determined by and in accordance with utility availability. Only the area which can be served with utilities be rezoned. The rezoning shall be finalized with the filing of the final plat. 4. Only that area which can be served with utilities shall be final platted. 5. Payment of the park dedication fees -in -lieu of dedication in accordance with dedication policy in effect at the time of filing the final plat. 6. Compliance with City Council Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions or on sites adjacent to or containing any open storm water drainage facility. Resolution No. 81-370 Page 2 7. Street names and numbers to comply with the City's street naming system. 8. No building permits to be issued until the final plat is filed and recorded with Hennepin County. 9. The final plan shall include detailed landscape plans of the single family attached units. 10. Bylaws and covenants for the homeowner association shall be approved by the City Attorney and, if applicable, address proposed encumbrances on the common area. 11. Outlot A be platted as part of proposed Lot 17, Block 2 of the preliminary plat. 12. Provide typical setback graphics for the units in the final stage. 13. The access drives be no closer than 50 feet to the right- of-way of public intersections. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Threinen , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Hoyt, Schneidor and Threi nen The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
