Pursuant ':o due call and notice thereof, a _ regular meeting of the City
Council of the City of Plymouth, Minnesota, was held on tie 15th day of

Cguncjlmember Schneider introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 81- 369
AUTHORIZING THE VACATION OF
A PORTION OF 6TH AVENUE IN WAYZATA FARMSTEADS ,ADDITION
!4HEREAS, a petition was received to vacate a portion of 6th Avenue in Wayzata
Farmsteads Addition; and
WHEREAS, a public hearing with respect to said vacation was held on May 18, 1981
in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of May 18, 1981; and
WHEREAS, the Council did hold a public hearing on May 18, 1981 to inform any and
all interested parties relevant to the vacation of a portion of 6th Avenue in
Wayzata Farmsteads Addition; and
WHEREAS, it was determined by the City Council that a certain portion of 6th Avenue
is not needed for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA as follows:
1. That the following portion of 6th Avenue be vacated as public roadway:
All that part of 6th Avenue adjacent to the Northerly side of Lot 1,
Wayzata Farmsteads Addition described as follows:
That part of 6th Avenue North originally dedicated in the plat of
"Wayzata Farmsteads," according to the recorded plat thereof, lying
West of the Northerly extension of the East line of Lot 1, said
"Wayzata Farmstead:," and Easterly of the Northerly extension of the
Westerly line of said Lot 1, except
A permanent street and utility easement over, under, across and
through that part of the above-described parcel which is inside a
60 foot radius circle, the radius point of which is located on the
centerline of Queensland Lane, 60 feet South of the South line of
the Fazendin-Krogness Addition, as measured along the centerline of
Queensland Lane.

2. That said vacation shall not affect the authority of any person,
corporation, or municipality owning or controlling electric or
telephone poles and lines, gas and sewer lines, or water pipes, mains
and hydrants thereon or thereunder, to continue maintaining the same
or to enter upon such way or portion thereof vacated to repair,
replace, remove or otherwise attend thereto.
3. That the City reserves trail/pedestrian easement over the entire
vacated street right-of-way.
The motion for the adoption of the foregoing Resolution was duly seconded
by Councilmember Hoyt , and upon vote being taken thereon, the
10 following voted in favor thereof: Mayor Davenport, Councilmembers Hoyt,
Schneider and Threinen
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
