Pursuant to due call and notice thereof, a regular meetinn of
10 the City Council of the City of Plymouth, Minnesotanesota was held on the

Councilmember Hoyt introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-358
REQUEST FOR PAYMENT NO. 11 AND FINAL
PINEVIEd LANE UTILITY AND STREET IMPROVEMENTS
PROJECT NO. 806
WHEREAS, the City of Plymouth as owner and Progressive Contractors, Inc. as
contractor have entered into an agreement for the improvement of Pineview Lane
utility and street improvements, said agreement being dated April 18, 1979; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the oriainal contract amount was $915,516.85, three change
orders were approved in the amount of $110,046.49, and the value
of the work completed and certified to date is $1,028,592.31.
2. That the work performed by the contractor for Project No. 806 and
certified to the Council by the engineer as acceptable be and the
same is hereby released from the contract except as to the condi-
tions of the performance bond, any and all legal rights of the
owner, required guarantees and corrections of faulty work after
final payment.
3. Request for Payment No. 11 and Final in the amount of $24,993.47 to
Progressive Contractors, Inc. for Project No. 806 is hereby approved
and the City Finance Director is hereby authorized and directed to
pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by

Whereupon the Resolution was declared duly passed and adopted.
