Th- following memhers were present:Mavor Davenport, Councilmemb_ers Hoyt, Neils, Schneider and Threinen. The following members were absent: none Counc_i_lmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 81-338 DENYING CONDITIONAL USE PERMIT FOR NEW HORIZON ENTERPRISES, INC. FOR A.DAY CARE CENTER TO BE LOCATED IN THE FOUR SEASONS OFFICE BUILDING AT 4205 NORTH LANCASTER LANE (81021) WHEREAS, New Horizon Enterprises, Inc., has requested approval of a Conditional Use Permit to operate the New Horizon Day Care Center in the Four Seasons Office Building at 4205 North Lancaster Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and has recommended denial; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLY- MOUTH, MINNESOTA, that it should and hereby does deny the request of New Horizon Enterprises, Inc. for a Conditional Use Permit to operate the New Horizon Day Care Center located in the Four Seasons Office Building at 4205 North Lancaster Lane on the basis that the use is adverse to the health, safety and welfare of the occupants of the surrounding area, and the effect on the Comprehensive Plan. The motion for the adoption of the foregoing Resolution was duly seconded by , and upon vote being taken thereon, the following voted in favor thereof: Mavor Davenport, Councilmembers Neils, Schneidpr and Threinen _ me following voted against or abstained: Councilmi Whereupon the Resolution was declared duly passu
