moved its adoption:
RESOLUTION NO. 81-337
APPROVING PRELIMINARY PLAT AND GENERAL DEVELOPMENT PLAN FOR "ROCKFORD SQUARE"
FOR JOHN McKELLIP AND NORMAN P. JARNESS (81013)
WHEREAS, John McKellip and Norman Jarness have requested approval of a Preliminary
Plat and General Development Plan for a commercial development on both sides
of Nathan Lane north of County Road 9 and south of 45th Avenue North; and,
WHEREAS, the request has been reviewed by the Planning Commission at duly called
public hearings and has received a recommendation for approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLY-
MOUTH, MINNESOTA, that it should and hereby does approve the request of John
McKellip and Norman P. Jarness for approval of a Preliminary Plat and General
Development Plan for "Rockford Square" based upon submitted Exhibit 'B' dated
May 1981 subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Park dedication policy requirements to be satisfied with individual
site development; to include 20 foot trail easement along the
north boundary of the property west of Nathan Lane and a 20 foot
trail easement along the west side of Nathan Lane.
3. Reference to approved general development plan shall be filed
in the appropriate form approved by the City Attorney with the
title to the property for reference by future prospective developers.
4. Detailed transition plans, including landscaping, berming, and other
approved features, shall be submitted with the final plat for that
area between the commercial area and the adjacent residential develop-
ments to the west, north and south. Said plan shall be coordinated
with the residential development to the west and shall be fully imple-
mented as part of the plat development contract notwithstanding the
staging of actual site plan development.
5. All restaurants within the proposed development shall be Class I
restaurants and shall be so designated on the approved general
development plan.

6. The final number of curb cuts onto Nathan Lane sFall be a function
of final site plan approval; all property within the preliminary
plat on both sides of Nathan Lane shall be included in the final plat.
7. No building permits to be issued until final plat is filed with
Hennepin County.
8. All diseased or dead trees on the property shall be removed
at the owner's expense as a condition of the Development Contract.
9. Compliance with City policy regarding subdivisions and develop-
ments adjacent to or containing storm water holding facilities.
10. Individual conditional use permits will be evaluated on their
merits at the time of site plan approval.
11. A traffic generation analysis accounting for the existing
zoning, proposed development, and existing and proposed
transportation system improvements shall be prepared by the City's
traffic consultant under the direction of the City Engineer in
conjunction with the final plat submittal; costs of said study
shall be borne by the petitioner.
12. The ponding requirements with respect to Lot 3, Block 2 shall be
addressed by the City Engineer and, if undevelopable within the
requirements for ponding, Lot 3 shall be combined with Lots 1
and/or 2.
13. The proposed use of the bowling alley, restaurant and lounge, as
shown on the General Development Plan, is specifically excluded and
should be permitted retail sales and/or office use only.
The motion for the adoption of the foregoing Resolution was duly seconded
by Cquncil ber ThreJnQn , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Councilmembers Hoyt,
NeJlA_ Schneider and Threinen
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
