Pursuant to due call and notice thereof, a regular meetino of
the Ci8[h Council of the City of Plymouth, M nnesota was held on tie
day of May . 19 81. The following members were
present: Acting Mayor Neils. Councilmembers Schneider b Threinen
The following members were absent: _may or Davenport. Councilmember Hoyt
Councilmember Schneider introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-298
ADOPTING ASSESSMENT
SEWER AND WATER AREA - WILLOW GROVE 2ND ADDITION
PROJECT NO. 121
WHEREAS, in conformance with the Development Contract, we have received a waiver
of assessment hearing from the property owner of Willow Grove Second Addition
waiving their right to special assessment hearings covering the installation of
water trunk facilities, sanitary sewer trunk facilities and all other appurtenances;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a part
hereof, is hereby accepted and shall constitute the special assessment against
the lands named therein and each tract of land therein included is hereby
. bound to be benefited by the proposed improvement in the amount of thc- assess-
ment levied against it.
2. Such assessment shall be payable in equal annual installments extenCing over
a period of 5 years, the first of the installments to be payable on or before
the first Monday in January 1982 and shall bear interest at the rate of 8%
per annum from the date of adoption of this assessment resolution. To the
first installment shall be added interest on the entire assessment from the
date of this resolution until December 31, 1982. To each subsequent install-
ment, when due, shall be added interest of one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification
of the assessment to the County Finance Director, pay the whole of the assess-
ment on such property with interest accrued to the date of payment to the City
Treasurer, except that no interest shall be charged if the entire assessment
is paid within thirty days from the adoption of this resolution; and he may,
at any time thereafter, pay to the City Finance Director the entire amount
of the assessment remaining unpaid with interest accrued to December 31 of
the year in which such payment is made.
4. The Clerk shall forthwith transmit a certified duplicate of this assessment
to the County Finance Director to be extended on the proper tax lists of the
County and such assessments shall be collected and paid over in the same
manner as other municipal taxes.
5. The total cost of the improvement assessed by this resolution is $67,416.00.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember lhreinen , and upon vote being taken thereon, the
f-ollowing voted n favor thereof: _Acting Mayor Neils, Councilmembers

Whereupon the Resolution was declared duly-passeirand adopted.
