The following members were present:Mayor Davenport, Co ncilmembers Neils Schneider and Threinen The following members were absent: Councilmember Hoyt Councilmember Threinen introduced the following Resolution and moved Its adoption. RESOLUTION NO. 81-286 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT AND VARIANCE FOR WALLACE E. FREEMAN FOR "WILLOW GROVE CONDOMINIUMS" LOCATED AT THE NORTHWEST CORNER OF NATHAN LANE AND BETTY CROCKER DRIVE (81003) WHEREAS, Wallace E. Freeman has requested approval of a conditional use permit, site plans and variances for 90 multi -family units known as the "Willow Grove Condominiums" at the northwest corner of Nathan Lane and Betty Crocker Drive (extended); and, WHEREAS, the Planning Commission reviewed the item at two meetings including a duly called public hearing and recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the conditional use permit and site plans for Wallace E. Freeman for "Willow Grove Condominiums" per plans dated April, 1981 subject to the following conditions: 1. Compliance with the City Engineer's Memorandum for this project. 2. No building permits to be issued until the final plat has been approved for the site and has been filed with Hennepin County. 3. The approved number of dwelling units shall be 78 based upon density allow- ances per Ordinance criteria #1 and #2; and additional 6 units per Criteria #6 will be permitted only upon demonstration by the petitioner of a bona fide low to moderate income housing approval by federal and/or state agencies prior to the issuance of permits. The maximum number of units not to exceed 84. 4. Compliance with City Ordinance and Policy regarding curbing and driving and parking areas. 5. Compliance with City Code as to fire lanes and fire hydrant requirements. 6. Positive barrier through berming and landscaping in the northwest area to prohibit vehicular traffic from the site to Quaker Lane. 7. Any signage shall not exceed Ordinance standards. Payment of Park Dedication fees in lieu of land dedication based upon approved number of units in accordance with City Park Dedication Policy in effect at the time of building permit issuance. 9. Submittal of ordinance -required financial guarantee for completion of approved site improvements termed for 24 months from date of building permit is nuance. 10. Trash disposal facilities shall be contained within the building in a manner consistent with appropriate codes. There shall be no outside storage or trash disposal facility. 11. Berming shall be in accordance with the City's adopted Landscape Criteria and shall not exceed a three to one slope, ther shall be no changes to the landscape plan without recommendation of Planning Commission and Council approval. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote beinu taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Neils, Scbneidpr and n The following voted against or abstained: Whereupon the Resolution was declared duly passed and adopted.
