Pursuant to due call and notice thereof, a re ular meeting of
the pity Council of the City of Plymouth, Minnesota was held on the
4t:, gay of May , 1981 . The following members were
present: Mayor Davenport, Councilmembers Neils, Schneider and Threinen_
The following members were absent: Councilmember Hoyt
Councilmember Schneider introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-283
DENYING THE VACATION OF A PORTION OF STREET EASEMENT
WEST OF FERNBROOK LANE AND SOUTH OF 27TH AVE.
WHEREAS, a pe_ition was received from Magney Construction Company to vacate a
portion of a street easement west of Fernbrook Lane and south of 27th Ave; and
WHEREAS, a public hearing with respect to said vacation was held on May 4, 1981
in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, the property owner on the north adjacent to the requested vacation
objected at the public hearing to said vacation because said street is being used
as access to the property; and
WHEREAS, an agreement could not be reached between the adjacent property owners
with respect to a a private driveway access agreement;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the request to vacate the street right-of-way west of Fernbrook
Lane and south of 27th Ave. is hereby denied.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Neils , and upon vote being taken therein, the
following voted in favor ereo : Mayor Davenport, Councilmembers ,Neils,
