Pursuant to due call and notice thereof, a regular maeting of
the City Council of the City of Plymouth, Minnesota was he d on the
20th day of April , 19_aL. The following members were
present: Mayor Davenport, Councilmembers_Hoyt_,_Neils_. Schneider and Threinen•
The following members were absent: None
Councilmember Hoyt introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-270
REQUEST FOR PAYMENT NO. 12 AND FINAL
FERNBROOK LANE - HIGHWAY 55 TO COUNTY ROAD 9 UTILITY AND STREET IMPROVEMENTS
PROJECT NO. 804
WHEREAS, the City of Plymouth as owner and C. S. McCrossan, Inc. as contractor
have entered into an agreement for the improvement of Fernbrook Lane - Highway 55
to County Road 9 utility and street improvements, said agreement being dated
October 30, 1978; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $779,603.00, two change orders
were approved in the amount of $12,399.95, and the value of the work
completed and certified to date is $801,464.83.
2. That the work performed by the contractor for Project No. 804 and
certified to the Council by the engineer as acceptable be and the
same is hereby released from the contract except as to the conditions
of the performance bond, any and all legal rights of the owner, required
guarantees and corrections of faulty work after final payment.
3. Request for Payment No. 12 and Final in the amount of $17,064.18 to
C. S. McCrossan, Inc. for Project No. 804 is hereby approved and the
City Finance Director is hereby authorized and directed to pay the
same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
and upon vote being taken thereon, the
following voted n favor ereo : Mayor Davenport, Councilm mbers Hoyt, Neils,
S ngideg and Dayenport
The following voted against orabstained: None
Whereupon the Resolution was declared duly passed and adopted.
