The following members were present: Mayor oavpr.22rt, Coyncilmembers, Hoyt, Schneider and Threinen The following members were a sent: Councilmember Neils rte* •�• •�• IoWncilmember Hoyt introduced the following Resolution and moved its tion: RESOLUTION NO. 81-249 REQUEST FOR PAYMENT NO. 3 AND FINAL TURTLE LAKE AND HARBOR LANE SANITARY SEWER PROJECT NO. 920 AND 009 WHEREAS, the City o� Plymouth as owner and Northdale Construction Co., Inc. as contractor have entered into an agreement for the improvement of Turtle Lake and Harbor Lane sanitary sewer, said agreement being dated April 14, 1980; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment; . NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $96,881.50, no change orders were approved, and the value of the work completed and certified to date is $96,143.01. 2. That the work pErformed by the contractor for Project No. 920 and 009 and certified to the Council by the engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and corrections of faulty work after final payment. 3. Request for Payment No. 3 and Final in the amount of $2,768.59 to Northdale Construction Co., Inc. for Project No. 920 and 009 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith.
