Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Plymouth, Minnesota, was held on the
6th day of April , 19 81 . The following members
were present: Mayor Daven ort, Councilmembers Ho ttSchneider & Threinen
The following members were absent: Councilmember Neils
Councilmember Schneider introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81- 213
A RESOLUTION REVOKING 1980-81 ON AND OFF SALE
NON -INTOXICATING MALT LIQUOR AND SET-UP LICENSES TO
SUSAN ESTELLE GORE HUCKELL dba APPLE BLOSSOM INN
WHEREAS, the Hennepin County Environmental Health Department has advised
the City that the Apple Blossom Inn is not in conformance with thirteen
provisions of the Hennepin County Food Protection Ordinance; and
WHEREAS, the City is subject to the Hennepin County Food Protection Ordinance;
and
WHEREAS, the owner and operator of the Apple Blossom Inn has not made any
attempt to come into compliance with the Hennepin County Food Protection Ordinance;
and
WHEREAS, Plymouth City Code Section 1005.21 provides that a license issued
by the City may be denied, suspended or revoked by the Council for conducting
such licensed activity in a manner so as to constitute a menance to health,
safety or welfare of the public; and
WHE-REAS, a public hearing was held on April 6, 1981, pursuant to City Code
to establish cause for revocation of said on and off sale non -intoxicating
malt liquor and set-up licenses; and
WHEREAS, following said hearing, and further consideration of the issue, the
Council has established cause for revocation of the license under City Code
provision 1005.21 including:
I. Failure to secure a County food and beverage license which is a
pre -condition for the issuance of city on and off sale non -intoxicating
malt liquor and set up licenses.
2. Failure to correct thirteen violations of Hennepin County Ordinance
No. 3 relating to food protection and sanitation.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does immediately revoke the
1980-81 on and off sale non -intoxicating malt liquor and set-up licenses
issued to Ms. Susan Estelle Gore HUCKell dba Apple Blossom Inn.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Ho t , and upon vote being taken thereon, the
following voted in favor t ereo : Mayor Davenport, Councilmembers Hoyt,
Schneider & Threinen
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopted.
