HomeMy WebLinkAboutCity Council Resolution 1981-202CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meetinof the City Council of the City of Plymouth, Minnesota, was a on the 23rd day of March , 1981 . The following members were present: -Acting Mayor Neils, counci members Hoyt. Schneider and Threinen Acting Mayor Neils introduced the following Resolution and moved is adoption: RESOLUTION NO. 81-202 APPROVING PRELIMINARY PLAT AND PLAN, AND CONDITIONAL USE PERMIT FOR CENTURION COMPANY FOR "FOX FOREST" RPUD 81-2 (80045) WHEREAS, Centurion Company has requested approval of a preliminary plat and plan and conditional use permit for "Fox Forest" RPUD for 165 dwelling units on 40.08 acres located north and east of the intersection of State Highway 55 and the Minnesota Western Railroad and east of Oakview Lane in the southwest quarter of Section 26; and, WHEREAS, the Planning Commission has considered the request following a duly called public hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Centurion Company for preliminary plat and plan and conditional use permit for "Fox Forest" RPUD 81-2 for 165 dwelling units on 40.08 acres located north and east of the intersection of State Highway 55 and the Minnesota Western Railroad and east of Oakview Lane in the southwest quarter of Section 26 subject to the following conditions: I. Compliance with the City Engineer's Memorandum. 2. Completion of the required Environmental Assessment Worksheet process prior to submittal of final plat and plan. 3. Final plat and plan submittal to be in accordance with PUD requirements. 4. I.inal plat to include detailed landscaping plan prepared in accordance with the City's Landscape Criteria clearly showing the proposed staging. 5. Staging of the development shall be in accordance with utility availability to the site including the east -west public street. 6. Final plan to include through sections showing the transition from the development to the single family residential areas to the north and north- west. Resolution N 81-202 Page 2 7. The number of permits issued will be'limited to Phase I, that portion of the project lying within Lots 1 and 2, Block 2, until the City Council determines the capacity of the single road access to this site. 8. Street access shall be provided to the boundaries of the exception properties at the northeast corner of the site. 9. Final plans to indicate details of any proposed permanent signage and any proposed project model homes/sales offices. 10. Final plans to indicate specific provision for trash disposal facilities in accordance with ordinance requirements. 11. Final plans to indicate detailed fire protection per City Code including adequacy of internal roads for emergency vehicle access. 12. Park Dedication to be in accordance with current Park Dedication Policy at the time of filing of final plat and shall include dedication of a 75 foot wide trail corridor along the south boundary, which shall be reduced to 50 feet abutting the westerly buildings. 13. A homeowner's association shall be established and bylaws approved by the City Attorney to maintain, in perpetuity, the open space and private streets 10 and utilities. 14.. Petitioner shall promptly submit a petition for the construction of 18th Avenue North, water and sanitary sewer improvements in that right-of-way with construc- tion to commence by 1982 and to be completed in the 1983 construction season.
