Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Plymouth, Minnesota was heTF on the
2nd day of March , 19 81. The following members were
present:M,aXor Davenport. Councilmembers Hoyt Neils, Schneider & Threinen
The following members were absent: None
Councilmember Neils introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-172
REQUEST FOR PAYMENT NO. 4 AND FINAL
COMMUNITY PLAYFIELDS, SCHEDULE A, GRADING
PROJECT NO. 017
WHEREAS, the City of Plymouth as owner and Veit and Company as contractor have
entered into an agreement for the improvement of Community Playfields, Schedule
A. Grading, said agreement being dated June 16, 1980; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $129,999.00, two change orders
were approved in the amount of $3,297.00 and the value of the work
completed and certified to date is $144,351.42.
2. That the work performed by the contractor for Project No. 017, Schedule
A and certified to the Council by the engineer as acceptable be and
the same is hereby released from the contract except as to the conditions
of the performance bond, any and all legal rights of the owner, required
guarantees and corrections of faulty work after final payment.
3. Request for Payment No. 4 and final in the amount of $15,569.14 to
Veit and Company for Project No. 017, Schedule A is hereby approved
and the City Finance Director is hereby authorized and directed to
pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Hoyt , and upon vote being taken thereon the
following voted in avor ereo : Mayor Davenport, Councilmembers Voyt,
Neils Schneider & Threinen
The following voted against orabstained: e
Whereupon the Resolution was declared duly passed and adopted.
