Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Plymouth, Minnesota was heT3 on the -
2nd day of March 11981 . The following members were
present: Mayor Davenport, ounce mem ers Hoyte; Neils, Schneider & Threinen
The following members were absent: None
Councilmember Neils introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-170
REQUEST FOR PAYMENT NO. 8 AND FINAL
PIKE LAKE AREA AND PINEVIEW LANE UTILITIES
PROJECT NO. 806 & 809
WHEREAS, the City of Plymouth as owner and Nodland Associates, Inc. as contractor
have entered into an agreement for the improvement of the Pike Lake Area and Pine -
view Lane Utilities, said agreement being dated October 26, 1978; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1. That the original contract amount was $626,222.60, one change order
was approved in the amount of $13,050.00, and the value of the work
completed and certified to date is $626,836.37.
2. That the work performed by the contractor for Project No. 806 and
809 and certified to the Council by the engineer as acceptable be
and the same is hereby released from the contract except as to the
conditions of the performance bond, any and all legal rights of the
owner, required guarantees and corrections of faulty work after
final payment.
3. Request for Payment No. 8 and final in the amount of $14,791.34 to
Nodland Associates, Inc. for Project No. 806 and 809 is hereby approved
and the City Finance Director is hereby authorized and directed to pay
the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
CguncilmeMber Hoyt , and upon vote being taken thereon, the
following vo n favor thereof: Mayor Davenport, Councilmembers Hoyt, Neils,

Whereupon the Resolution was declared duly passed and adopted.
