HomeMy WebLinkAboutCity Council Resolution 1981-151CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth. Minnesota, was held on the 2nd day of March * 19 81 . The following members were present: ng members were absent: Mayor Davenport *•t Councilmember Hoyt introduced the following Resolution and moved Its adoption: RESOLUTION NO. 81- 151 ^.PPROVING PRELIMINARY REGISTERED LAND SURVEY FOR THOMAS HUMPHREY AT THE SOUTH- WEST QUADRANT OF PINEVIEW LANE AND FUTURE COUNTY ROAD 15 (81008) WHEREAS, Thomas Humphrey has requested approval of a preliminary registered land survey and general development plan for approximately 30 acres which includes two existing single family dwellings located in the southwest quadrant of Pineview Lane and future County Road 15; and, WHEREAS, the Planning Commission has considered the request following a duly called public hearing and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the preliminary registered land survey and general development plan for Thomas Humphrey for approximately 30 acres located in the southwest quadrant of Pineveiw Lane and future County Road 15 subject to the following conditions: I. Compliance with the City Engineer's Memorandum dated February 11, 1981. 2. Payment of park dedication fees in lieu of land dedication for new tracts as they are final platted in accordance with City Park Dedication Policy in effect at the time of filing. 3. Designation of Future County Road 15 as 6th Avenue North. 4. No private drive access allowed onto future County Road 15. 5. Revision to general development plan to indicate proper minimum yard setback for lots abutting future County Road 15; and acknowledgment of the same in the development contract. 6. Revision of general development plan to consolidate proposed Lots 4 and 5, Block 2 into a single parcel with the intention of providing for compliance with minimum ordinance dimension standards and possible future internal access to proposed Tract A should it be subject to further division. 7. No private drive access onto County Road 15 including proposed Tract A should present private drive be amended or should the Tract be subject to further subdivision. Resolution No. 81-151 Page 2 8. Variance request for metes and bounds "interim" division shall be granted upon the granting of necessary easements and submission of a letter of agreement between the purchaser and seller of Lot B agreeing to proceed with the filing of the final Registered Land Survey petition. The motion for the adoption of the foregoing Resolution was duly seconded by Coyncil er Neils, and upon vote being taken thereon, the following voted in favor thereof:-Imeoprs Hayt and Neils Councilmember.Schneider voted nay—and Counci member Threinen abstained Whereupon the Resolution was declared duly passed and adopted.
