Nei S h wider A Threinen Th;following members were absent:— mayor Davenport itrtir tir* tn►� Councilmember Hoyt introduced the following Resolution and moved Its adoption: RESOLUTION NO. 81-149 APPROVING VARIANCE FROM SUBDIVISION CODE FOR THOMAS HUMPHREY TO PERMIT A PROPERTY DIVISION FOR LAND LOCATED IN THE SOUTHWEST QUADRANT OF PINEVIEW LANE AND FUTURE COUNTY ROAD 15 (6TH AVENUE NORTH)(81008) WHEREAS, Thomas Humphrey has requested a variance from the Subdivision Code to permit a property division for land located in the southwest quadrant of Pineview Lane and future County Road 15 (6th Avenue North) to allow the sale of an exist- ing single family home; and, WHEREAS, the Planning Commission has reviewed said request; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY GF PLYMOUTH, MINNESOTA, that it should and hereby does approve the variance from the Subdivision Code for Thomas Humphrey to permit a property division for land located in the southwest quadrant of Pineview Lane and future County Road 15 (6th Avenue North) as follows: EXISTING LEGAL DESCRIPTION That part of the NE4 of the SE4 of Section 34, Township 118, Range 22 described as follows: Beginning at a point in the West line of the NE14 of the SW4 of said Section 34 distant 325.75 feet south of the judicial landmark located at the NW corner of said NE4 of the SE4 of said section; thence South along the West line of said NE4 of the SE4 200 feet; thence at a right angle East 125 feet; thence SEly deflecting 32 degrees to the right from the last described course 212 feet; thence Southeasterly deflecting 29 degrees 36 minutes to the right from the last -described course 306.85 feet to a point 450 feet East of the West line and 400 feet North of the South line of the NE4 of the SE -14- of Section 34; thence South parallel with the West line of said tract 77.8 feet; thence NEly deflecting 113 degrees to the left from the last described course 423.8 feet; thence NWly deflecting 93 degrees to the left from the last described course 550 ffet to a point 600 feet East of the point of beginning measured at a right angle to the West line of the NE4 of the SE4 of Section 34; thence West 600 feet to the point of beginning, and the location of an existing building and driveway (P.I.N. 34-118-22-41-0007). To be divided into two new parcels as follows: PARCEL A: That part of the Northeast quarter of the Southeast quarter of Section 34, Township 118, Range 22, described as follows: Beginning at a point in the West line of the Northeast quarter of the Southeast quarter of said sec- tion 34 distant 325.75 feet South of the judicial landmark located at the Resolution No. 81-149 Page 2 Northwest corner of said Northeast quarter of the Southeast quarter of said section: thence South along the West line of said Northeast quarter of the Southeast quarter 200 feet; thence at a right angle East 125 feet; thence Southeasterly deflecting 32 degrees to the right from the last -described course 212 feet; thence Southeasterly deflecting 29 degrees 36 minutes to the right from the last -described course 306.85 feet to a point 450 feet East of the West line and 400 feet North of the South line of the Northeast quarter of the Southeast quarter of the Southeast quarter of said Section 34; thence South parallel with the West line of said tract 77.8 feet; thence Northeasterly deflecting 113 degrees to the left from the last described course 423.8 feet; thence Northwesterly deflecting 93 degrees to the left from the last -described course 550 feet to a point 600 feet East of the point of beginning measured at a right angle to the West line of the North- east quarter of the Southeast quarter of Section 34; thence West 600 feet to the point of beginning, Lying Easterly of a line hereinafter referred to as "Line A", said "Line A" being described as follows: Commencing at a point on the West line of said Northeast quarter of the Southeast quarter distant 325.75 feet South of the judicial landmark located at the Northwest corner of said Northeast quarter of the Southeast quarter, said West line having an assumed bearing of North for the purposes of this description; thence on a bearing of East a distance of 589.95 feet; thence North 19 degrees 01 minutes 08 seconds a distance of 105.6 feet to the point of beginning of said "Line A"; thence South 19 degrees 01 minutes 08 seconds West a distance of 105.6 feet; thence Southwesterly on a tangential curve to the right having a radius of 498.96 feet and central angle of 21 degrees 07 minutes 58 seconds a distance of 184.04 feet to a point of compound curvature; thence Southwesterly on a tangential curve to the right having a radius of 304.99 feet and central angle of 29 degrees 57 minutes 02 seconds a distance of159.43 feet; thence South 26 degrees 31 minutes 40 seconds East to the Southeasterly line of said above-described property, and said "Line A" there ending. PARCEL B: All of that part of the existing parcel described above (P.I.N. 34-118-22- 41-0007) EXCEPT for Parcel A described above. FURTHER, that the City Manager be authorized to make the necessary special assess- ment corrections based upon City policy when the division is approved by Hennepin County. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted in favor thereof: Councilmembers Hoyt and Neils Councilmember Schneider Voted nay and-Councilmember Thr@inen abstained Whereupon the Resolution was declared duly passed and adopted.
