Pursuant to due call and notice thereof, a r-eameeting of
the City Council of the City of Plymouth, nnesot , was a on the
2nd day of March , 19 81 The following members
were present: Mayor Davenport, Councilmembers Hoyt,—Neils, Schneider & Threinen.
The following members were absent: None
Councilmember Hoyt introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-140
AUTHORIZING THE VACATION OF 15TH AVE., 16TH AVE., KIRKWOOD LANE,
JONQUIL LANE, IVES LANE AND 119TH ST. IN BEACON HEIGHTS 2ND ADDITION
NORTH OF THE MINNESOTA WESTERN RAILROAD
WHEREAS, a petition was received to vacate all that part of 15th Ave., 16th Ave.,
Kirkwood Lane, Jonquil Lane, Ives Lane and 119th St. in Beacon Heights 2nd Addition
north of the Minnesota Western Railroad; and
WHEREAS, a public hearing with respect to said vacation was held on March 2, 1981
in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of March 2, 1981; and
WHEREAS, the Council did hold a public hearing on March 2, 1981 to inform any and
all interested parties relevant to the vacation of all that part of 15th Ave., 16th
Ave., Kirkwood Lane, Jonquil Lane, Ives Lane and 119th St. in Beacon Heights 2nd
Addition north of the Minnesota Western Railroad; and
WHEREAS, it was determined by the City Council that all that part of 15th Ave., 16th
Ave., Kirkwood Lane, Jonquil Lane, Ives Lane and 119th St. in Beacon Heights 2nd
Addition north of the Minnesota Western Railroad are not needed for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA as follows:
1. That the following be vacated as public roadway:
All that part of 15th Ave., 16th Ave., Kirkwood Lane, Jonquil Lane, Ives Lane
and 119th St. in Beacon Heights 2nd Addn. north of the Minnesota Western Railroad.
2. That said vacation shall not affect the authority or any person, corporation
or municipality owning or controlling electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder,
to continue maintaining the same or to enter upon such way or portion thereof
vacated to repair, replace, remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Threinen , and upon vote being taken thereon, the
