HomeMy WebLinkAboutCity Council Resolution 1981-139CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, M nnesota, was he d on the 2nd day of March , 19 81 . The following members were present:__Mayor Davenport, ounce members Hoyt, Neils, Schneider & Threinen The following members were absent: None Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO.81-139 AUTHORIZING THE VACATION OF WESTWOOD CIRCLE IN IVANHOE WOODS ADDITION WHEREAS, a petition was received to vacate a portion of Westwood Circle in Ivanhoe Woods Addition; and WHEREAS, a public hearing with respect to said vacation was held on March 2, 1981 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of March 2, 1981; and WHEREAS, the Council did hold a public hearing on March 2, 1981 to inform any and all interested parties relevant to the vacation of Westwood Circle in Ivanhoe Woods Addition; and WHEREAS, it was determined by the City Council that Westwood Circle in Ivanhoe Woods Addition is not needed for a public street; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA as follows: 1. That the following be vacated as public roadway: All that part of Westwood Circle lying easterly of the east line Saratoga Lane extended southeasterly from the northerly tangent point of a 53.33 ft. radius curve on Lot 21, Block 1, Ivanhoe Woods Addition. 2. That said vacation shall not affect the authority of any person, corporation or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by and upon vote being taken thereon, the following vote n favor thereof:- Mayor Davenport.
