Pursuant to due call and notice thereof, a regijlar meeting of
the City Council of the City of Plymouth, Minnesota, was held on the
2nd day of March , 19 81 . The following members
were present:Mayor Davenport, Councilmembers Hoyt, Neils, Schneider & Threinen
The following members were absent: None
Councilmember Schneider introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-136
AUTHORIZING THE VACATION OF A PORTION OF 16TH AVENUE
IN PLYMOUTH ORCHARDS ADDITION
WHEREAS, a petition was received to vacate a portion of 16th Avenue in Plymouth
Orchards Addition; and
WHEREAS, a public hearing with respect to said vacation was held on March 2, 1981
in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of March 2, 1981; and
WHEREAS, the Council did hold a public hearing on March 2, 1981 to inform any and
all interested parties relevant to the vacation of a portion of 16th Avenue in
Plymouth Orchards Addition; and
WHEREAS, it was determined by the City Council that a portion of 16th Avenue in
Plymouth Orchards Addition is not needed for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA as follows:
That the following be vacated as public roadway:
All that part of 16th Avenue adjacent to the northerly side of Lot 7,
Block A, Plymouth Orchards Addition and west of the westerly line of
Water Tower Circle extending southeasterly to intersect the south line
of 16th Avenue.
2. That said vacation shall not -ffect the authority of any person, corporation
or municipality owning or CL .rolling electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants tiiereon or thereunder,
to continue maintaining the same or to enter upon such way or portion thereof
vacated to repair, replace, remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Neils and upon vote being taken thereon, the
