Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Plymouth, Minnesota, was held on the
2nd d,,• of March , 19 81 . The following members
were present: Mayor Davenport, Counci members Hoyt, Neils, Schneider & Threinen
The following members were absent: None
Councilmember Neils introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-135
AUTHORIZING THE VACATION OF A PORTION OF 15-1/2 AVENUE OR 15TH PLACE
IN PLYMOUTH ORCHARDS ADDITION
WHEREAS, a petition was received to vacate a portion of 15-1/2 Avenue or
15th Place in Plymouth Orchards Addition; and
WHEREAS, a public hearing with respect to said vacation was held on March 2,
1981 in accordance with Minnesota Statutes 412.851, as amended; and
WHEREAS, a notice of publication of said hearing was published and posted
two weeks prior to the meeting of March 2, 1981; and
WHEREAS, the Council did hold a public hearing on March 2, 1981 to inform
any and all interested parties relevant to the vacation of a portion of
15-1/2 Avenue/15th Place; and
WHEREAS, it was determined by the City Council that a certain portion of
15-1/2 Avenue or 15th Place is not needed for a public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOT1, as follows:
I. That the following be vacated as public roadway:
All that part of 15-1/2 Avenue or 15th Place adjacent to the southerly
side of Lots zli, G, and 7, Block A, Plymouth Orchards Addition.
2. That said vacation shall not affect the authority of any person, corporation
or municipality owning or controlling electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder,
to continue raintaining the same or to enter upon such way or portion thereof
vacat.Qa to repair, replace, remove or otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Threinen , and upon vote being taken thereon, the
following voted in favor thereof:Mavor Davenport. Councilmembers Hoyt, Neils_
Schneider & Threinen
The following voted against or abstained: None
Whereupon the Resolution was declared duly passed and adopte
