Pursuant to due call and notice thereof, a regular meetino_ of
the City Council of the City of Plymouth, Minnesota was held on the
19th day of January , 1981 . The following members were
present: Mayor Davenport, ounce mem ers Hoyt, Neils, Schneider & Threinen.
The following members were absent: None
Councilmember Hoyt introduced the following Resolution and
moved its adoption:
RESOLUTION NO. 81-63
REQUEST FOR PAYMENT NO. 8 AND FINAL
MEDINA ROAD AREA UTILITIES
PROJECT NO. 908
WHEREAS, the City of Plymouth as owner and Nodland Associates, Inc as contractor
have entered into an agreement for the improvement of the Medina Road area, said
agreement being dated June 28, 1979;
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
10 MINNESOTA:
1. That the oil,inal contract amount was $328,479.50, four chancre orders
were approvri in the amount of $38,516.00, and the value of the work
completed ani certified to date is $384,682.60.
2. That the work performed by the contractor for Project No. 908 and
certified to the Council by the engineer as acceptable be and the
same is hereby released from the contract except as to the conditions
of the performance bond, any and all legal rights of the owner, required
guarantees and corrections of faulty work after final payment.
3. Request for Payment No. 8 and final in the amount of $21,829.37 to
Nodland Associates, Inc. for Project No. 908 is hereby approved and
the City finance director is hereby authorized and directed to pay
the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by

The following voted against orabstained: None
Whereupon the Resolution was declared duly passed and adopted.
