HomeMy WebLinkAboutCity Council Resolution 1981-040CITY OF PLYMOUTH Pursuant to due call and notice thereof, a Regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 19th day of January , 1981 . The following members were present: Mayor Davenport. Councilmembers Neils, Schneider, Hoyt $ Th reinen. The following members were absent: None Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 81-40 AUTHORIZING THE VACATION OF OAKWOOD LANE AND ADJACENT EASEMENTS IN WIND RIDGE AT BASS LAKE ADDITION WHEREAS, a petition was received to vacate Oakwood Lane and adjacent easements in Wind Ridge at Bass Lake Addition; and WHEREAS, a public hearing with respect to said vacation was held on August 25, 1980 in accordance with Minnesota Statutes 412.851, as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of August 25, 1980; and WHEREAS, the Council did hold a public hearing on August 25, 1980 to inform any and ali interested parties relevant to the vacation of Oakwood Lane and adjacent easements in Wind Ridge at Bass Lake Addition; and WHEREAS, it was determined by the City Council that Oakwood Lane and adjacent easements in Wind -Ridge at Bass Lake Addition are not needed for a public street or utility/drainage easements; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, as follows: 1. That the following street and utility/drainage easements are vacated: Oakwood Lane adjacent to Lot 3, Blk. 1 and Lots 3, 4 and 5, Blk. 2, Wind Ridge at Bass Lake Addition and the utility and drainage ease- ments in said lots. 2. That said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines or water pipes, mains and hydrants thereon o- thereunder, to continue maintaining the same or to anter upon such way or portion thereof vacated to repair, replace, remove or otherwise attend thereto. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Hoyt , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers Nails. Schneider, Hoyt and Threinen The following voted against or abstained: None Whereupon the Resolution was declared duly passed and adopted.
