The following members were present: a oravenpor ounc;members Hoyt, Neils, Schneider and Threinen The following ers were absent: None �r tiro *tt Councilmember Threinen introduced the following Resolution and moved Its adoption: RESOLUTION NO. 81-35 APPROVING PRELIMINARY PLAT AND CONDITIONAL USE PERMIT FOR WIND RIDGE TOWNHOUSES FOR LUNDGREN BROS. CONSTRUCTION COMPANY (80026) WHEREAS, Lundgren Bros. Construction Company has requested approval of rezoning, preliminary plat, and conditional use permit for a project consisting of two -unit condominium attached dwellings on approximately 13.45 acres north of the Soo Line Railroad tracks and east of Pineview Lane; and, WHEREAS, the City Council reviewed the rezoning proposal on July 21, 1980 and deferred action pending further design demonstration as to compliance with the City's transition policy; and, WHEREAS, the Planning Commission has reviewed the proposal at duly called public hearings and meetings and has recommended approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the preliminary plat and condi- tional use permit for Wind Ridge Townhouses for Lundgren Bros. Construction Company consisting of two -unit attached condominium dwelling units on approxi- mately 13.45 acres east of Pineview Lane and north of the Soo Line Railroad tracks subject to the following conditions: 1. Compliance with the City Engineer's Memorandum for this project. 2. Submittal of revised landscape plan with the final plat to reflect approved street and lot layout responsive to the City's LA -1 RPUD Transition Policy. 3. Park dedication and fees in lieu of dedication to be consistent with City Park Dedication Policy in effect at the time of filing the final plat. 4. Final plat and plan shall include applicable provisions of the preliminary plat for Wind Ridge At Bass Lake (formerly "Cricket Hills") per Resolution No. 77-490 (A-755). 5. No building permits shall be issued until approved final plat has been filed with Hennepin County. 6. Homeowners Association agreements shall be reviewed and approved by the City Attorney; the association shall be responsible for the outlot. Resolution 0 81-35 Pap 2 7. Review of the trail alignment, location, and design by PRAC to determine the possibility of eliminating the trail on the north side of the tracks prior to final plat. 8. 53rd Avenue North shall be moved 10 feet to the south where possible to eliminate front yard setback variances. 9. One pair of lots (one building) shall be deleted to eliminate as many of the lot width variances as possible; revised plans reflecting the adjust- ment shall be submitted for final site plan approval with the final plat. 10. There shall be no further subdivision of Outlot A, including the City - owned parcel. 11. Final plat and development contract shall include construction of 53rd Avenue to Larch Lane and consolidation of lot remnant abutting Larch Lane and 53rd with Outlot A. 12. Developer shall adhere to the RPUD transition policy for an LA -1 area with R -1B zoning in the northwest portion of the plat, specifically on Lots 6, 7, and 8 of Block 3 in the 1st Addition.
