The following members were �pWncilmembRr Hoyt introduced the following Resolution and moved its adoption: RESOLUTION! NO. 81-17 ADOPTING ASSESSMENT PLYMOUTH COVENANT CHURCH - PROJECT NO. 029 WHEREAS, the City of Plymouth has received a Waiver of Assessment Hearing from Plymouth Covenant Church, the property owner of 16-118-22 22 0003 and 16-118-22 23 0001, waiving their right to special assessment hearings covering the installation of water - main trunk facilities, sewer trunk facilities, water lateral and sewer lateral and all other appurtenances; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of five years, the first of the installments to be payable on or before the first Monday in January, 1982 and shall bear interest at the rate of 8% per annum. To the first installment shall be added interest on the entire assessment from Janulary 1, 1982 to December 31, 1982. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Finance Director, pay the whole of the assessment on such property, with interest accrued to the date of payment to the City Finance Director, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution and he may, at any time thereafter, pay to the City Finance Director the entire amount of the assess- ment remaining unpaid with interest accrued to December 31 of the year in which such payment is made. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Finance Director to be extended on the proper tax lists of the County and such assessments shall be collected and paid over in the same manner as other municipal taxes. 5. The total cost of the improvement assessed by this resolution is $40,112.06. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Neils , and upon vote being taken thereon, the following voted n favor thereof: Mayor Davenport, Councilmembers Hoyt, Neils Schneider and Threinen TFW75511owing voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted. www re,tt ,r**
