The following members were present: Mayor Davenport, Councilmembers Hoyt Neils Schneider and Treinen. The following mem ers were absent: none tet* *** *** Councilmember Hoyt introduced the following Resolution and moved its adoption: RESOLUTION NO. 81- 08 REQUEST FOR PAYMENT NO. 10 AND FINAL FERNBROOK LANE AND RIDGECREST AREA UTILITIES PROJECT NO. 804 AND 829 WHEREAS, the City of Plymouth as Owner and C. W. Houle, Inc. as Contractor have entered into -,n agreement for the improvement of Fernbrook Lane and Ridgecrest Area, said Agreement being dated September 11, 1978; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the Final Request for Payment; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $765,916.00, one change order was approved in the amount of $26,474.00, and the value of the work completed and certified to date is $773,841.19. 2. That the work performed by the Contractor for Project No. 804 and 829 and certified to the Council by the Engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the Performance Bond, any and all legal rights of the Owner, required guarantees and Corrections of Faulty work after final payment. 3. Request for Payment Pio. 10 and Final in the amount of $22,514.99 to C. W. Houle, Inc. for Project No. 804 and 829 is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Schneider , and upon vote being taken thereon, the following voted in favor ereo : Mayor Davenport, Councilmembers Hoyt, Neils, Schneider and Threinen The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
