Purpose of Meeting: To discuss potential litigation on the issue of the rezoning and reguiding
of land for a Sam's Club on land owned by Carlson Resl Estate Company south of
Carlson Parkway and east of I-494
1. Legal analysis and implications of Council actions to date.
A. Public Hearings.
B. Council actions on 12/6, 12/20, and 1/3.
C Current status.
2. Discuss legal options regarding possible rescinding of the rezoning/reguiding
A. Procedural options and potential legal ramifications of each:
1. Procedure for reversing January P motion if desired.
2. Proceed with a full hearing at Planning Commission or not.
3. Notice to neighborhood if full hearing not conducted.
4. Voting requirement for rescinding action.
B. Findings of fact needed for rescinding action.
C. Analysis of potential claims with various options.
3. Discuss administrative process alternatives and legal ramifications.
A. Processing of Preliminary/Final Plat application.
B. Submission of Guide Plan Amendment to the Metropolitan Council.
4. Discuss content and legal aspects of proposed covenant.
5. Other related issues or concerns.
