HomeMy WebLinkAboutCity Council Resolution 2013-227CITY OF PLYMOUTH RESOLUTION No. 2013-227 A RESOLUTION APPROVING THE VACATION OF A PORTION OF THE DRAINAGE EASEMENT FOR PONDING AND UTILITY PURPOSES WITHIN LOT 2, BLOCK 1, WEST SUBURBAN HEALTH CAMPUS THIRD ADDITION WHEREAS, a public hearing with respect to said vacation was scheduled for July 9, 2013, in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of July 9, 2013, and WHEREAS, the City Council did hold a public hearing on July 9, 2013, to inform any and all interested parties relevant to the vacation of a portion of the drainage easement for ponding and utility purposes within Lot 2, Block 1, West Suburban Health Campus Third Addition; and WHEREAS, it was determined by the City Council that said easement is not needed for public purposes. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the drainage easement for ponding and utility purposes described as follows be vacated: That part of Lot 2, Block 1, West Suburban Health Campus Third Addition, according to the recorded plat thereof, Hennepin County, Minnesota, described as follows: Commencing at the most easterly corner of said Lot 2; thence northwesterly, along the northeasterly line of said Lot 2, a distance of 156.51 feet; thence South 47 degrees 24 minutes 21 seconds West, based on the most northerly line of said Lot 2 having an assumed bearing of EAST, a distance of 107.83 feet to the point of beginning of the land to be described; thence South 47 degrees 24 minutes 21 seconds West a distance of 11.56 feet; thence North 82 degrees 13 minutes 47 seconds West a distance of 151.60 feet; thence North 42 degrees 35 minutes 38 seconds West a distance 78.25 feet; thence southerly to the point of beginning and there terminating. FURTHER, that said vacation shall not effect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas theron or thereunder, to continue maintain the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof. FURTHER, that the recording of this resolution shall be recorded with, but prior to the recording of West Suburban Health Campus Fourth Addition plat. Approved this 9th day of July 2013.
