RESOLUTION No. 2013-226
A RESOLUTION APPROVING THE VACATION OF
ROADWAY (STREET) EASEMENTS ON DUNKIRK LANE NORTH
WITHIN NORTH 1/2 SECTION 5, TOWNSHIP 118, RANGE 22
WHEREAS, a public hearing with respect to said vacation was scheduled
for July 9, 2013, in accordance with Minnesota Statutes 412.851 and the City
Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and
posted two weeks prior to the meeting of July 9, 2013; and
WHEREAS, the city Council did hold a public hearing on July 9, 2013, to
inform any and all interested parties relevant to the vacation of roadway (street)
easements on Dunkirk Lane North within north '/z Section 5, Township 118,
Range 22; and
WHEREAS, it was determined by the City Council that said easements are
not needed for public purposes; and
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the roadway
(street) easements described as follows be vacated:
Parcel Description:
Parcel Area No. 1 — That part of the south '/z of the northwest'/4 of Section 5,
Township 118 North, Range 22, west of the 5th principal meridian, Hennepin
County, Minnesota, described as follows:
Commencing at the northeast corner of said south '/z of the northwest '/4; thence
south along the east line of said south '/z of the northwest'/4 a distance of 579.34
feet; thence deflect 89 degrees 15 minutes right a distance of 283 feet; thence
deflect 90 degrees 45 minutes right a distance of 578.47 feet to the north line of
said south '/z of the northwest '/4; thence east along said north line a distance of
283 feet to the point of beginning.
Easement Description:
Roadway (street) easement over, under, across and through the east 33 feet of the
above described parcel except that part lying northerly of a line 60 feet southerly
of the centerline of County Road 47 and easterly of the northerly extension of the
easterly line of Lot 1, Block 1, Terra Vista, Hennepin County, Minnesota.
Parcel Description:
Parcel Area No. 2 — Lots 1, 2 and 4, Block 1 and Lot 1, Block 7, Terra Vista,
Hennepin County, Minnesota
Easement Description:
Roadway (street) easement over, under, across and through the west 33 feet of
the above described lots in Terra Vista.
FURTHER, that said vacation shall not effect the authority of any person,
corporation, or municipality owning or controlling the electric or telephone poles and
lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural
drainage areas thereon or thereunder, to continue maintain the same or to enter upon such
way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend
thereof.
FURTHER, it is not in the public's interest to vacate the drainage and utility
easements within Lots 1, 2 and 4, Block 2 and Lot 1, Block 7, Terra Vista and they shall
be retained by the City.
FURTHER, it is not in the public's interest to vacate the drainage and utility
easement portion of the east 10 feet of Parcel Area No. 1 and it shall be retained by the
City.
FURTHER, it is not in the public's interest to vacate the drainage and utility
easement portion lying 10 feet westerly of and adjacent to the northerly extension of the
easterly line of Lot 1, Block 1, Terra Vista and it shall be retained by the City.
