HomeMy WebLinkAboutCity Council Ordinance 2013-20CITY OF PLYMOUTH HENNEPIN COUNTY, MINNESOTA AN ORDINANCE AMENDING CHAPTER 21 (ZONING ORDINANCE) OF THE CITY CODE TO CLASSIFY CERTAIN LAND LOCATED AT 16440 COUNTY ROAD 47 (2013023) THE CITY OF PLYMOUTH ORDAINS: Section 1. Amendment of City Code. Chapter 21 of the city code of the City of Plymouth, Minnesota, is hereby amended by changing the classification on the City of Plymouth Zoning Map from FRD (future restricted development) to PUD (planned unit development) for property described as follows: Parcel 1: That part of west 60 acres of Northeast % Section 5 Township 118 Range 22 lying northerly of Hennepin County Highway Number 47 except that part thereof described as commencing at northeast corner of said west 60 acres; thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning; thence south 89 degree 51 minutes 58 seconds west, 320.00 feet; thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly along said right of way to said east line; thence northerly along said east line to point of beginning. Subject to highway, Hennepin County, Minnesota. Parcel 2: That part of west 60 acres of northeast % Section 5, Township 118, Range 22, described as commencing at northeast corner of said west 60 acres; thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning; thence south 89 degree 51 minutes 58 seconds west, 320.00 feet; thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly along said right of way to said east line; thence northerly along said east line to point of beginning. Subject to highway, Hennepin County, Minnesota. Section 2. Amendment of City Code. Chapter 21 of the city code of the City of Plymouth, Minnesota, adopted December 18, 2006 as amended, is hereby amended to add Section 21655.58 Steeple Hill 2nd Addition PUD, as follows: 21655.53 Steeple Hill 2nd Addition: Subd. 1. Legal Description. This PUD is currently legally described as follows: Parcel 1: That part of west 60 acres of Northeast '/a Section 5 Township 118 Range 22 lying northerly of Hennepin County Highway Number 47 except that part thereof described as commencing at northeast corner of said west 60 acres; thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning; thence south 89 degree 51 minutes 58 seconds west, 320.00 feet; thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly along said light of way to said east line; thence northerly along said east line to point of beginning. Subject to highway, Hennepin County, Minnesota. Parcel 2: That part of west 60 acres of northeast '/a Section 5, Township 118, Range 22, described as commencting at northeast corner of said west 60 acres; thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning; thence south 89 degree 51 minutes 58 seconds west, 320.00 feet; thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly along said right of way to said east line; thence northerly along said east line to point of beginning. Incorporated herein by reference are the Steeple Hill 2"d Addition plans received by the city on April 4 and May 9, 2013, except as may be amended by City Council Resolution 2013-195, on file in the office of the zoning administrator under file 2013023. Subd. 3. Allowable Uses. The allowable uses for all the lots are any permitted or accessory uses allowed in the RSF-3 zoning district. These uses shall be considered "permitted" in the PUD, provided they comply with all the development standards and conditions approved by City Council Resolution 2013-196, on file in the office of the zoning administrator under file 2013023. Subd. 4. Development Standards. Development standards shall be as indicated on the PUD general plan approved by City Council Resolution 2013-196, on file in the office of the zoning zdministrator under file 2013023. Section 3.
