RESOLUTION No. 2013-197
A RESOLUTION APPROVING A SITE PLAN AMENDMENT, CONDITIONAL USE
PERMIT AMENDMENT, AND VARIANCES FOR ATHLETIC FACILITY IMPROVEMENTS
AT PROVIDENCE ACADEMY, 15100 SCHMIDT LAKE ROAD (2013024)
WHEREAS, Providence Academy has requested approval of a site plan amendment,
conditional use permit amendment, and variances relating to athletic facility improvements at
15100 Schmidt Lake Road; and
WHEREAS, the subject property is legally described as Lot 1, Block 1, Providence
Academy, Hennepin County, Minnesota; and
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request
for a site plan amendment, conditional use permit amendment, and variances to allow athletic
facility improvements at 15100 Schmidt Lake Road, subject to the following conditions and
findings:
1. The site plan amendment is approved to allow alterations to and expansion of athletic
facilities, in accordance with the plans received by the city on May 23, 2013, except as may
be amended by this resolution.
2. The conditional use permit amendment is approved to allow a 93,000 square foot air -
supported seasonal dome over the football field, in accordance with the plans received by
the city on May 23, 2013, except as may be amended by this resolution, based on the finding
that the applicable conditional use permit standards have been met.
3. Variances are approved to allow: 1) the height of the seasonal dome to be 66 feet; and
increased fence height along front lot lines, in accordance with the plans received by the city
on May 23, 2013, except as may be amended by this resolution, based on the finding that the
applicable variance standards have been met.
4. Separate building permits or grading permits are required prior to the commencement of
constriction related to the project.

5. The lights for the outdoor ice rink shall be turned off not later than 10:30 PM.
6. The dome shall not be set up and in place for more than six months at a time (during the
winter months).
7. The lights for the seasonal dome shall be shut off and all activities shall cease within the
seasonal dome by not later than 10:30 PM.
8. The netting system (including support poles) for the baseball field may be put up at the
beginning of the school baseball season and shall be taken down when the school baseball
season is over.
9. Prior to commencement of site work, the following items shall be completed:
a. The applicant shall submit a site improvement performance agreement and financial
guarantee for completion of the proposed site improvements, as required by the city.
b. The applicant shall revise the lighting plan to reduce the mounting height of the light
fixtures for the outdoor ice skating rink to not more than 25 feet.
c. The applicant shall revise the landscaping plan to substitute three spruce trees for three
deciduous trees.
d. The applicant shall revise the landscaping plan to increase the tree size to three inch
caliper for deciduous trees and eight feet in height for conifers in the area where homes to
the west have a direct sight line to the dome.
e. The applicant shall extend the existing trail on the north side of Schmidt Lake Road
easterly to the relocated east driveway, and shall include a pedestrian ramp where the
extended trail ties into the relocated driveway.
f. The applicant shall receive city approval of final constrictions plans.
10. Standard Conditions:
a. The lighting plan shall comply with the city's lighting regulations, including the
requirement for house -side shielding.
b. Any subsequent phases or expansions are subject to required reviews and approvals
pursuant to ordinance provisions.
c. The approval is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
d. Except as may otherwise be amended under the approvals granted by this resolution, the
approvals and related conditions of Resolution No. 2008-148 shall remain in full force
and effect for eight years from the date of this resolution, and the site plan amendment,
conditional use permit amendment, and variances approved by this resolution shall
remain in full force and effect for eight years from the date of this resolution. All such
approvals shall expire eight years after the date of this resolution, unless the property
owner or applicant has started the project, or unless the applicant, with the consent of the
property owner, has received prior approval from the city to extend the expiration date
for up to one additional year, as regulated under sections 21045.09, 21015.07, and
21030.06, respectively, of the zoning ordinance.
