HomeMy WebLinkAboutCity Council Resolution 2013-196CITY OF PLYMOUTH RESOLUTION No. 2013-196 A RESOLUTION APPROVING A PUD GENERAL PLAN FOR STEEPLE HILL 2"D ADDITION ON PROPERTY LOCATED AT 16440 COUNTY ROAD 47 (201 3023) WHEREAS, GWS Land Development of Plymouth, LLC. has requested approval of a PUD general plan for the property legally described as follows: Parcel 1: That part of Nyest 60 acres of Northeast '/4 Section 5 Township 118 Range 22 lying northerly of Hennepin County Highway Number 47 except that part thereof described as commencing at northeast corner of said Nyest 60 acres: thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning, thence south 89 degree 51 minutes 58 seconds Nyest, 320.00 feet: thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly along said right of way to said east line; thence northerly along said east line to point of beginning. Subject to highway, Hennepin County, Minnesota. Parcel 2: That part of Nyest 60 acres of northeast '/4 Section 5, Township 118, Range 22, described as commencing at northeast corner of said Nyest 60 acres: thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning; thence south 89 degree 51 minutes 58 seconds west, 320.00 feet: thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47, thence northeasterly along said right of way to said east line; thence northerly_ along said east line to point of beginning. Subject to highway, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve the request by GWS Land Development of Plymouth, LLC for a PUD general plan, subject to the following conditions: 1. A PUD general plan is approved to allow 51 single-family dwellings, according to the plans received by the city on April 4 and May 9, 2013, except as amended by this resolution. 2. Approval of this PUD general plan is contingent on approval of the comprehensive plan amendment, rezoning, and wetland mitigation plan. Development standards shall be as indicated on the plans and materials dated April 4 and May 9, 2013, except as amended by this resolution. 4. The following setbacks shall apply to all lots, except as noted: a. A 25 -foot building setback measured from the rights-of-way of all local streets. b. A 25 -foot rear building setback. c. An eight -foot side -yard building setback for living area and a six-foot garage setback (regardless of living area above or behind) except that the setback from the east property line of Lot 51 shall be eight feet regardless of living area or garage. A 15 -foot stricture setback from the wetland buffers, except that uncovered decks and at - grade patios may be located up to nine feet from the wetland buffers and retaining walls are permitted within the setback to the wetland buffer. e. A 50 -foot building setback from the County Road 47 right-of-way. f. Other strictures and improvements shall be reviewed consistent with Section 21115.04 of the zoning ordinance. 5. No building permits shall be issued until a PUD final plan is approved by city staff. 6. With the PUD final plan application, the applicant shall submit the following. consistent with the city code and the zoning ordinance, specifications for the fence to be installed on the top of the retaining wall along County Road 47 and elsewhere along County Road 47. 7. Prior to issuance of a building permit for the single-family homes, the applicant shall submit the following plans and materials: a) A certified survey for each lot that includes the location, size and specie of the two required overstory trees to be planted in the front yards. b) Any retaining walls to be installed on the property or on the property lines must be shown on the survey. No installation of retaining walls shall be permitted in drainage and utility easements without approval of an encroachment agreement. 8. All signage shall require separate permits and shall be in conformance with section 21155 in the zoning ordinance. APPROVED THIS 25TH DAY OF JUNE, 2013.
