HomeMy WebLinkAboutCity Council Resolution 2013-195CITY OF PLYMOUTH RESOLUTION No. 2013-195 A RESOLUTION APPROVING A PRELIMINARY PLAT FOR GWS LAND DEVELOPMENT OF PLYMOUTH, LLC FOR "STEEPLE HILL 2ND ADDITION" FOR PROPERTY LOCATED AT 16440 COUNTY ROAD 47 (2013023) WHEREAS, GWS Land Development of Plymouth, LLC. has requested approval of a preliminary plat for the roughly 22 -acre parcel presently legally described as follows: Parcel 1: That part of west 60 acres of Northeast '/4 Section 5 Township 118 Range 22 lying northerly of Hennepin County Highway Number 47 except that part thereof described as commencing at northeast corner of said west 60 acres: thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning, thence south 89 degree 51 minutes 58 seconds west, 320.00 feet: thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly along said right of Nvav to said east line; thence northerly_ along said east line to point of beginning. Subject to highway, Hennepin County, Minnesota. Parcel 2: That part of west 60 acres of northeast '/4 Section 5, Township 118, Range 22, described as commencing at northeast corner of said west 60 acres: thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning; thence south 89 degree 51 minutes 58 seconds west, 320.00 feet: thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly along said right of way to said east line; thence northerly_ along said east line to point of beginning. Subject to highway, Hennepin Countv, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by GWS Land Development of Plymouth, LLC. for a preliminary plat for "Steeple Hill 2"a Addition", subject to the following conditions: 1. A preliminary plat is approved to allow the property to be subdivided into 51 single-family lots, in accordance with the application and plans received by the city on April 4 and May 9, 2013, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the comprehensive plan amendment, rezoning the site to PUD and a wetland mitigation plan. 3. No private driveway access from any lot shall be permitted to the County Road 47. 4. Prior to wetland disturbance, the applicant shall request and receive approval of a wetland mitigation plan. Prior to recording the final plat, the applicant shall: 1) pay the park dedication cash fee with credit for land to be dedicated for trail outlots, in accordance with the ordinance in effect at the time the final plat is recorded; 2) pay sewer and water area assessments; 3) receive City approval of final constriction plans; 4) execute a development contract and submit related financial guarantees and 5) remove the house and all accessory buildings and fences. 6. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: (1) Provide HOA documents for the development that include language addressing the following: 1) prohibition of strictures and clearing vegetation in wetland buffers and 2) maintenance for common elements including buffer monuments, median plantings, mailboxes, monument signs, shared retaining walls, sidewalks, etc. (2) Submit fire flow calculations and provide the total square footage of the largest proposed stricture. (3) Execute an encroachment agreement for retaining walls in drainage and utility easements. (4) Revise the plans to indicate a temporary emergency secondary access to County Road 47 and submit a cash deposit to guarantee its removal when the stub street is connected to the west. (5) Revise the landscaping plan to relocate trees proposed within the wetland buffer or within 10 feet of utility mains to approved locations. (6) For Wetland B, submit documentation indicating the proposed buffer area and the area of a 30 -foot average wetland buffer. (7) Revise the buffer monuments to add and relocate to approved locations. (8) Revise the plans to include a temporary cul-de-sac on the western end of the stub street. (9) Where permission is granted, revise the tree inventory to include trees on adjacent properties within 15 feet of disturbance. (10) Consider amending the plat to save the mature catalpa trees on Lots 1 and 51, adding catalpa to the list of trees replanted in the subdivision or replanting catalpa trees along the eastern property border. 7. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted, and b. Silt fence and tree preservation fencing installed consistent with city code. 8. The temporary secondary access lane to County Road 47 may be removed when the stub street is extended to the west and connected to County Road 47. 9. Standard Conditions: a. With the exception of a model home, no building permits shall be issued until the final plat, agreements, and easements are filed and recorded with Hennepin County. b. Compliance with the city's tree preservation regulations. c. Removal of all hazardous trees from the property at the owner's expense. Res. 2013-195 File 2013023 Page 3 d. This approval shall expire one year after the date of approval, unless the applicant has applied for final plat approval, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
