HomeMy WebLinkAboutCity Council Resolution 2013-194CITY OF PLYMOUTH RESOLUTION No. 2013-194 A RESOLUTION APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR PROPERTIES LOCATED AT 16440 COUNTY ROAD 47 (201302 3) WHEREAS, GWS Land Development of Plymouth, LLC. has initiated a comprehensive plan amendment to reguide properties with a total of roughly 22 acres currently guided P -I (public/semi-public/institutional) and LA -3 (living area 3) to LA -2 (living area 2); WHEREAS, the property affected by the amendment is legally described as follows: Parcel 1: That part of west 60 acres of Northeast'/4 Section 5 Township 118 Range 22 lying northerly of Hennepin County Highway Number 47 except that part thereof described as commencing at northeast corner of said west 60 acres; thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning, thence south 89 degree 51 minutes 58 seconds west, 320.00 feet: thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly along said right of Nvav to said east line; thence northerly_ along said east line to point of beginning. Subject to highway, Hennepin County, Minnesota. Parcel 2: That part of west 60 acres of northeast '/4 Section 5, Township 118, Range 22, described as commencing at northeast corner of said west 60 acres: thence on an assumed bearing of S 00 degrees 08 minutes 02 seconds east along east line thereof, 496.14 feet to point of beginning; thence south 89 degree 51 minutes 58 seconds west, 320.00 feet: thence south 00 degrees 08 minutes 02 seconds east 323.54 feet to northerly right of way of Hennepin County Highway Number 47; thence northeasterly along said right of way to said east line; thence northerly_ along said east line to point of beginning. Subject to highway, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request initiated by GWS Land Development of Plymouth, Inc. for property located at 16440 County Road 47, based on the following findings: 1) The current conditions support a re-examination of the guiding. 2) The reguiding would be consistent with the location criteria for the LA -2 classification. 3) The reguiding would not adversely affect land supply or demand. 4) The reguiding has merit beyond the interests of the applicant. 5) The reguiding would not result in negative effects on other comprehensive plan elements. 6) The reguiding would not result in negative fiscal impacts to the city. FURTHER, approval of the comprehensive plan amendments is contingent upon, and subject to, the required review and response by the Metropolitan Council. APPROVED THIS 25TH DAY OF JUNE, 2013.
