RESOLUTION No. 2013-186
A RESOLUTION APPROVING A PRELIMINARY AND FINAL PLAT
FOR PETE PETER FOR "HOLLY LANE ADDITION"
FOR PROPERTY LOCATED AT 4400 HOLLY LANE NORTH (201 3027)
WHEREAS, Pete Peter has requested approval of a preliminary and final plat for the
roughly 1.4 -acre parcel presently legally described as follows:
Commencing at the point of intersection of the west line of the Northeast Quarter of the
Northwest Quarter with the center line of State Highway No. 55, commonly known as
Rockford Road as now laid out and traveled; thence north along the said west line of the
Northeast Quarter of the Northwest Quarter, 358 feet; thence East parallel with the center
line of State Highway No. 55, 165 feet; thence south parallel with the west line of said
Northeast Quarter of the Northwest Quarter, 358 feet to the center line of said State
Highway; thence west along center line of said State Highway to the point of beginning,
all in Section 17, Township 118, Range 22, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by Pete Peter for a preliminary and final plat for "Holly Lane Addition",
subject to the following conditions:
1. A preliminary and final plat is approved to allow the property at 4400 Holly Lane North to be
subdivided into two single-family lots, in accordance with the application received by the
city on April 17, 2013 and revised plans received on June 6, 2013, except as may be amended
by this resolution.
2. Approval of the preliminary and final plat is contingent upon City Council approval of the
rezoning of the site to RSF-1.
3. Prior to recording the final plat, the applicant shall:
a) pay park dedication cash fees for two lots, in accordance with the ordinance in effect at
the time the final plat is recorded.
b) revise the tree preservation plan to identify the removal of four trees near the sanitary
sewer manhole on the east property line (16 -inch Oak, 14 -inch Ash, 8 -inch Elm and 10 -
inch Ash) and the removal of the 14 -inch Maple located south of the proposed driveway
on the west lot line. The applicant shall also update the tree inch and percentage totals in
the tree inventory table.

c) provide a revised drainage plan to be reviewed and approved by city staff that
demonstrates that drainage to neighboring properties would not increase from the existing
condition.
d) receive city approval of final constriction plans.
4. Prior to construction of the home on Lot 2, Block 1, Holly Lane Addition, the applicant
shall obtain a building permit from the Building Division.
5. Prior to issuance of a building permit and prior to the removal of any trees or 2radin2,
the applicant shall install and request inspection of silt fencing and tree preservation fencing.
6. Standard Conditions:
a. No building permits shall be issued until the final plat, agreements, and easements are
filed and recorded with Hennepin County.
b. Compliance with the city's tree preservation regulations.
c. Removal of all hazardous trees from the property at the owner's expense.
d. This approval shall expire two years after the date of approval, unless the property owner
or applicant has recorded the final plat, or unless the applicant, with the consent of the
property owner, has received prior approval from the city to extend the expiration date
for up to one additional year, as regulated under section 512 of city code.
