TO ALLOW CONSTRUCTION OF AN AFFINITY PLUS FEDERAL CREDIT UNION FOR PROPERTY LOCATED SOUTH OF 34TH AVENUE BETWEEN PLYMOUTH BOULEVARD AND VICKSBURG LANE (2004016) WHEREAS, DJR Architecture, Inc. has requested approval of a site plan and variance to allow constriction of an Affinity Plus Federal Credit Union on property legally described as follows: Lot 1, Block 1, Plymouth Hills 7t1' Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by DJR Architecture, Inc. for a site plan and variance for property located south of 34th Avenue between Plymouth Boulevard and Vicksburg Lane, subject to the following conditions: 1. Approval of the site plan and variance is contingent upon City approval of the rezoning of this 1.5 -acre site from CC -RE (City Center, Retail/Entertainment) to CC -R (City Center, Retail). 2. A site plan and variance is hereby approved in accordance with the plans received by the City on March 19, 2004, except as may be amended by this resolution. 3. The variance is approved to allow a front yard setback of up to 49 feet along 341h Avenue, based on the finding that the applicable variance standards have been met. 4. Other than the variance specified in this resolution, no other variances are granted or implied. 5. Any awnings must be fabric material (e.g., canvas). Resolution 2004-166 (2004016) Page 2 6. Prior to the issuance of building permits, the applicant shall provide cut sheets for each of the proposed lighting fixtures to verify that the fixtures provide the shielding required by the Zoning Ordinance. 7. Prior to issuance of building permits, a revised landscape plan shall be submitted. The two honey locust trees shown along 34th Avenue shall be replaced with sugar maple trees, and all the red sunset maples shown on the site shall be changed to sugar maples. 8. All signs proposed shall require separate permits and shall be in conformance with the Zoning Ordinance. The applicant has agreed to omit the time/temperature display from the freestanding sign. 9. The applicant must obtain the appropriate permits from the Building Division prior to commencement of the project. 10. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 11. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 12. This approval shall expire one year after the date of approval, unless the landowner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21030.06 and 21045.09 of the Zoning Ordinance. 13. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. The applicant shall submit the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. c. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. d. Prior to issuance of building permits, the applicant shall submit fire flow calculations. e. The applicant shall submit an 8 1/2 x 11 inch "As Built" Fire Protection Plan prior to the release or reduction of any site improvement bonds per City Policy.
