RESOLUTION 2004-165
APPROVING FINDINGS OF FACT FOR REZONING OF PROPERTY LOCATED SOUTH
OF 34TH AVENUE BETWEEN PLYMOUTH BOULEVARD AND VICKSBURG LANE

WHEREAS, DJR Architecture, Inc., has requested reclassification of the zoning from CC -RE
(City Center, Retail/Entertainment) to CC -R (City Center, Retail) for the 1.5 -acre site located
south of 34t1' Avenue between Plymouth Boulevard and Vicksburg Lane, legally described as
follows:
Lot 1, Block 1, Plymouth Hills 7t1' Addition, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval; and
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from
CC -RE (City Center, Retail/Entertainment) to CC -R (City Center, Retail).
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for
reclassification of the zoning from CC -RE (City Center, Retail/Entertainment to CC -R (City
Center, Retail) for a 1.5 -acre site located south of 34t1' Avenue between Plymouth Boulevard and
Vicksburg Lane, based on the following findings:
1. The proposed rezoning is consistent with the Comprehensive Plan and other City policies
and plans.
2. The subject parcel meets the standards of the CC -R (City Center, Retail) zoning district.
3. There is adequate infrastructure available to support the CC -R zoning and the
development proposed for this site.
