HomeMy WebLinkAboutCity Council Resolution 2004-163CITY OF PLYMOUTH RESOLUTION 2004-163 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "SEVEN GREENS 2N" ADDITION" FOR SWAN DEVELOPMENT, LLC. FOR PROPERTY LOCATED AT THE NORTHEAST CORNER OF SCHMIDT LAKE ROAD AND VICKSBURG LANE. (2003133F) WHEREAS, Swan Development, LLC. has requested approval of a final plat for Seven Greens 2"' Addition, to allow the creation of 56 lots and four outlots for the final 34 single-family and 11 two-family dwellings on the 62.6 acre site located at the northeast corner of the intersection of Schmidt Lake Road and Vicksburg Lane; and WHEREAS, the property is legally described as follows: Outlot E and Outlot D, Seven Greens, according to the recorded plat thereof, Hennepin County, Minnesota WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Swan Development, LLC. for a final plat for Seven Greens 2"a Addition; and FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approves 56 lots including 34 seven single-family lots, 22 two-family lots, and four outlots in accordance with the plans received by the City on April 12, 2004, March 15, 2004, and February 10 and 18, 2004, except as may be amended by this Resolution. The following structural setbacks shall apply: a) 50 -foot setback from Schmidt Lake Road and Vicksburg Lane b) 50 -foot setback from the Canadian -Pacific Railroad right-of-way c) 25 -foot rear yard setback d) 15 -foot front yard setback for principal dwellings e) 25 -foot setback for front -loaded garages; 15 -foot front yard setbacks for side -loaded garages f) 6 -foot side yard setbacks for two-family homes and for attached or detached garages g) 10 -foot side yard setbacks for single-family homes 3. To accommodate the lesser front setbacks from the public right-of-way, the setbacks for driveways on corner lots shall be measured from the intersection of curb lines rather than the intersection of property lines. 4. No building permits shall be issued until the PUD final plan is approved by City staff. 5. Prior to the issuance of a grading or utility permit, the applicant shall submit a revised tree preservation plan and calculations including the impact of the changes of grade behind lots 4- 11, block 5. 6. Prior to recording the final plat, the applicant shall revise the easement note in the final plat drawing so that it agrees with the graphic display of a six-foot drainage and utility easement. 7. Prior to recording the final plat, the applicant shall revise the homeowner association documents to include notice to fi ture homeowners of Lots 4-11, Block 5 that the grades are subject to change as improvements to Vicksburg Lane North are constricted and that no trees, shrubs or similar landscaping may be planted west of the fence or within 10 feet of the stormsewer or water lines. 8. Prior to recording the final plat, the applicant shall revise the easement on the west side of Lots 4-11, Block 5 so that it is large enough to contain both the proposed water and storm sewer lines as well as an additional ten feet east of the proposed water line. 9. With the submittal materials for the PUD final plan, the applicant shall submit a revised landscaping plan that removes all landscaping within ten feet of the stormsewer and waterlines on the west side of Lots 4-11, Block 5. 10. With the submittal materials for the PUD final plan, the applicant shall submit revised final plans for lighting proposed to occur on private property in conformance with Zoning Ordinance requirements and in the public right-of-way (location and fixture details only). Prior to issuance of building permits, the applicant shall submit to the City the notice to be included in the development/sales documents informing potential buyers of the fi ture improvements to Vicksburg Lane, the potential change in grades, and the prohibition on landscaping in the easement area west of lots 4-11, block 5 and the fi ture trail east of Vicksburg Lane, between 51" Avenue and the presence of the railroad tracks. This notice shall be distributed to all potential buyers. 12. Prior to issuance of building permits around the greens, the applicant shall sign the greens for no parking consistent with the letter dated February 27, 2002 summarizing the results of the field testing. 13. Prior to issuance of building permits, the applicant must install the required permanent wetland buffer monuments pursuant to ordinance requirements. 14. Prior to the issuance of building permits, the final plat shall be filed and recorded with Hennepin County and proof of such recorded shall be fi rnished to the City. 15. Prior to the issuance of building permits, the homeowners association documents shall be filed and recorded with Hennepin County and proof of such recorded shall be fi rnished to the City. 16. The HOA shall be responsible for maintenance of sidewalks, boulevard plantings, wetland buffers, mailboxes, monument signs, amenity features as shown, and association common areas within this development. The HOA documents shall include language to address maintenance of these features. 17. The HOA documents shall include ownership and maintenance of the neighborhood green outlots, the walkway outlots, and the wetland outlot located in the southeast portion of the site. 18. The developer shall provide copies of the current overall PUD plan and its current conditions as an addendum to the purchase agreements for lots within this plat. 19. Private driveway access shall be limited to internal public roads and restricted from Vicksburg Lane. 20. The developer shall install a public trail, in accordance with City specifications, on the outlot deeded to the City for park purposes. The developer shall be responsible for the cost of grading, base preparation, and suitable ground cover related to installation of the trail. The developer shall be reimbursed for the pavement costs. 21. Parking shall be permitted on both sides of 28 -foot wide streets. Parking shall be permitted on one side of 24 -foot wide streets. Resolution 2004-163 (200313317) Page 4 22. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Prior to recording the final plat, the applicant shall submit the required easements as approved by the City Engineer. c. Removal of all hazardous trees from the property at the owner's expense. d. Compliance with the City's tree preservation regulations. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. f. No building permits shall be issued until a contract has been awarded for sewer and water. g. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. h. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release of any site improvement financial guarantees per City Policy. i. Prior to issuance of building permits, the applicant shall revise plans identify the domestic size of the combination fire/domestic water supply line if required, add/relocated hydrants as necessary, and show fire lane, address and directional signs in approved locations. j. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility.
