HomeMy WebLinkAboutCity Council Resolution 2004-135CITY OF PLYMOUTH RESOLUTION 2004-135 APPROVING A SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT, AND VARIANCES FOR CARLSON REAL ESTATE COMPANY FOR "TOWN CENTER OFFICE PLAZA" TO ALLOW CONSTRUCTION OF SIX TOWN OFFICE BUILDINGS FOR PROPERTY LOCATED AT 3501 PLYMOUTH BOULEVARD (2004012) WHEREAS, Carlson Real Estate Company has requested approval of a site plan amendment, conditional use permit, and variances to allow development of a town office project on property legally described as follows: Lot 3, Block 1, Plymouth Hills 6th Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Carlson Real Estate Company for a site plan amendment, conditional use permit, and variances for property located at 3501 Plymouth Boulevard, subject to the following conditions: 1. A site plan amendment, conditional use permit, and variances for a six -building town office development is hereby approved, in accordance with the plans received by the City on March 26, 2004, except as may be amended by this resolution. 2. A conditional use permit is approved to allow six principal buildings on the lot. A variance is approved to allow a front yard setback of up to 24.9 feet along Plymouth Boulevard, based on the finding that the applicable variance standards have been met. 4. Variances are approved to allow a detached trash enclosure, and for such trash enclosure to be setback 22 feet from the rear lot line, based on the finding that the applicable variance standards have been met. Variances previously approved in August of 2000 (extended in August 2002) allowing a parking setback of 15 feet from 36th Avenue and directional signage of ten square feet in area remain valid and in force, and are reflected in the amended site plan. 6. Other than the variances specified in this resolution, no other variances are granted or implied. 7. All signs shall require separate permits and shall be in conformance with the Zoning Ordinance. 8. Medical and dental office uses shall be allowable within this development only to the extent that parking is provided in compliance with ordinance requirements, because such uses generate a higher parking demand than general/professional office uses. 9. Prior to the issuance of building permits, the applicant shall provide the City with a copy of the CIC (Common Interest Community) documents and any other related association documents for the development. The documents shall address the shared parking agreement and the limitations on medical and dental uses within the project based on parking. 10. Prior to the issuance of building permits, the applicant shall submit a revised landscape plan that replaces the two honey locust trees shown along Plymouth Boulevard with Northwood maple trees, and that indicates a continuous planting of Northwood maple trees along that street with an approximate spacing of 35 feet to 40 feet on center. 11. Any awnings must be fabric material (e.g., canvas). 12. The two benches shown in the plaza area must meet City specifications. 13. Prior to submittal of the building permit application, any outstanding accessible requirements shall be addressed. 14. The applicant must obtain the appropriate permits from the Building Division prior to commencement of the project. 15. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 16. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 17. This approval shall expire one year after the date of approval, unless the landowner or applicant has substantially started constriction of the project, or unless the landowner or Resolution 2004-135 (2004012) Page 3 applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07, 21030.06, and 21045.09 of the Zoning Ordinance. 18. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. The applicant shall submit the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution prior to issuance of building permits. c. The applicant shall comply with the Ordinance regarding the location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. d. Prior to issuance of building permits, the applicant shall submit fire flow calculations. e. The applicant shall submit an 8 1/2 x 11 inch "As Built" Fire Protection Plan prior to the release or reduction of any site improvement bonds per City Policy.
