RESOLUTION 2004-134
APPROVING A PRELIMINARY PLAT FOR SVK DEVELOPMENT FOR "HIDDEN
MEADOWS AT CURTIS LAKE", A FIVE -UNIT, SINGLE-FAMILY DEVELOPMENT
LOCATED ON THE SOUTH SIDE OF WEST MEDICINE LAKE DRIVE AND
APPROXIMATELY 300 FEET WEST OF NORTHWEST BOULEVARD (2004003)
WHEREAS, SVK Development has requested approval of a preliminary plat for Hidden
Meadows at Curtis Lake, a plat of five lots for single-family dwellings on 9.89 acres located on
the south side of West Medicine Lake Drive and approximately 300 feet west of Northwest
Boulevard; and
WHEREAS, the property is legally described as follows:
That part of the northwest quarter of the southeast quarter of Section 10, Township 118,
Range 22, lying between the north 232 feet and the south 233 feet of said quarter quarter,
lying westerly of the centerline of the Town Road, except that part thereof described as
beginning at the intersection of the centerline of the Town Road with the north line of the
south 233 of said northwest quarter of the southeast quarter; thence west along said north
line to a point 440.4 feet west of the east line of said northwest quarter of the southeast
quarter; thence north at right angles to said north line 190 feet, more or less, to the
centerline of the Town Road; thence southeasterly along said centerline to the point of
beginning, according to the government survey thereof.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by SVK
Development for a preliminary plat for Hidden Meadows at Curtis Lake, subject to the following
conditions:

1. Approval of the preliminary plat is contingent upon City approval of the rezoning of the site to
RSF-3 (Single Family 3) and vacation of West Medicine Lake Drive.
2. This preliminary plat approves five single-family lots, in accordance with the plans received by
the City on March 10, 2004, except as amended by this Resolution.
3. Prior to issuance of a grading permit or as part of the final plat application, the applicant shall
revise the plans to show the silt fence no closer than five feet to the east property line of Lot
1.
4. As part of the final plat application, the applicant shall provide the City with copies of the
homeowner's association (HOA) documents for the neighborhood.
5. The HOA shall be responsible for maintenance of the rain garden and wetland buffer within
this development. The HOA documents shall include language to address maintenance of
these features.
6. As part of the final plat application, the applicant shall provide the City with plans that include
the location of all proposed street lights in the public right-of-way.
7. Prior to recording the final plat, the applicant shall submit the required utility and drainage
easements and rain garden agreements as approved by the City Engineer.
8. Prior to recording the final plat, the developer shall pay the park dedication fees, pursuant to
City Code at the time the final plat is approved, for the total number of units shown on the
plans.
9. Prior to issuance of grading or building permits, the tree preservation fencing shall be installed
and inspected and the required financial guarantee shall be submitted.
10. Development standards shall be as required by the RSF-3 district. No variances are granted
or implied.
11. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
c. With the exception of one building permit for a model home, no building permits shall be
issued until the final plat is filed and recorded with Hennepin County.
d. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
e. Signs shall require separate permits prior to installation.

f. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
g. As part of the final plat application, or prior to the issuance of any building or utility
permits, the applicant shall submit fire flow calculations in compliance with City Code and
other applicable codes.
h. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
strictures on sites adjacent to, or containing any open storm water drainage facility.
i. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Section 510 of City Code.
