HomeMy WebLinkAboutCity Council Resolution 2004-133CITY OF PLYMOUTH RESOLUTION 2004-133 APPROVING FINDINGS OF FACT FOR THE REZONING OF PROPERTY LOCATED ON THE SOUTH SIDE OF WEST MEDICINE LAKE DRIVE AND APPROXIMATELY 300 FEET WEST OF NORTHWEST BOULEVARD (2004003) WHEREAS, SVK Development has requested reclassification of the zoning from FRD (Future Restricted Development) to RSF-3 (Single Family 3) for 9.89 acres of land on the south side of West Medicine Lake Drive and approximately 300 feet west of Northwest Boulevard, legally described as follows: That part of the northwest quarter of the southeast quarter of Section 10, Township 118, Range 22, lying between the north 232 feet and the south 233 feet of said quarter quarter, lying westerly of the centerline of the Town Road, except that part thereof described as beginning at the intersection of the centerline of the Town Road with the north line of the south 233 of said northwest quarter of the southeast quarter; thence west along said north line to a point 440.4 feet west of the east line of said northwest quarter of the southeast quarter; thence north at right angles to said north line 190 feet, more or less, to the centerline of the Town Road; thence southeasterly along said centerline to the point of beginning, according to the government survey thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD (Future Restricted Development) to RSF-3 (Single Family 3); NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD (Future Restricted Development) to RSF-3 (Single Family 3) for 9.89 acres of land located on the south side of West Medicine Lake Drive and approximately 300 feet west of Northwest Boulevard, based on the following findings: Resolution 2004-133 Findings of Fact (2004003) Page 2 1. The proposed rezoning is consistent with the Comprehensive Plan and other City policies and plans. 2. The proposed development meets lot area and dimension requirements of the RSF-3 zoning district. 3. The proposed RSF-3 zoning district allows a development that meets the City's density goal specified in the City's land use plan. 4. Adequate infrastructure is available to support the RSF-3 zoning and the single-family development proposed for this site. ADOPTED by the City Council on April 13, 2004.
