HomeMy WebLinkAboutCity Council Resolution 2004-132CITY OF PLYMOUTH RESOLUTION 2004-132 APPROVING A CONDITIONAL USE PERMIT FOR JAMES AND LISA PROM TO ALLOW AN ATTACHED GARAGE CONTAINING OVER 1,000 SQUARE FEET FOR PROPERTY LOCATED AT 5760 OAKVIEW LANE NORTH (2004010) WHEREAS, James and Lisa Prom have requested a conditional use permit to allow an attached garage containing 1,700 square feet in gross floor area on property legally described as follows: Lot 7, Block 1, Palmer's Cove, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by James and Lisa Prom for a conditional use permit, subject to the following conditions: 1. A conditional use permit is approved to allow an attached garage containing 1,700 sqaure feet in gross floor area, as shown on the application and plans received by the City on February 9, 2004 and March 8, 2004, except as may be amended by this resolution. 2. The total impervious surface coverage for this lot shall not exceed 25 percent, in compliance with the shoreland overlay district regulations for Bass Lake. No driveway to the lower level storage area is requested or authorized. A driveway to that area would increase the impervious surface coverage above 25 percent, and therefore, would require prior City authorization under the variance process. Prior to issuance of the building permit, the applicant must obtain separate approval of an administrative permit to allow redevelopment of a lawfully non -conforming due to lot width at the front setback line (110 feet required and 98 feet as platted). 4. Standard Conditions: A. Compliance with the Engineer's Memo prior to, or in conjuction with, issuance of the building permit. B. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. C. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. D. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
