RESOLUTION 2004-065
A RESOLUTION REPLACING RESOLUTION NO. 95-671 APPROVING RPUD
FINAL PLAN/PLAT AND DEVELOPMENT CONTRACT FOR WESTON,
HILLOWAY CORP. AND MOEN LEUER CONSTRUCTION LOCATED WEST OF
VICKSBURG LANE AT SCHMIDT LAKE ROAD (94093)
WHEREAS, Weston, Hilloway Corp. and Moen Leuer Constriction have requested
approval of a Residential Planned Unit Development Final Plan/Plat for the development
of approximately 79.7 acres located west of Vicksburg Lane at Schmidt Lake Road; and,
WHEREAS, the City staff has prepared a Development Contract covering the
improvements related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
Final Plan/Plat and Development Contract for Nanterre for property located west of
Vicksburg Lane at Schmidt Lake Road; and,
FURTHER, that the Development Contract for said plat be approved, and that the Mayor
and City Manager be authorized to execute the Development Contract on behalf of the
City; and,
FURTHER, that the following conditions be met prior to recording of, and related to said
plat:
1. The Interim Wetland Regulations shall apply to Blocks 1 and 2 and to Outlots A
through L excluding Outlots H and K. Outlots H and K shall comply with the
Wetland Protection Ordinance.
2. Outlots A, B, C, E, F and G shall be dedicated to the City for Park Trail purposes.
The deeds for the Outlots shall be given to the City prior to filing the Final Plat
with Hennepin County.
3. Outlot I shall be dedicated to the City for park purposes. The deed for Outlot I
shall be given to the City prior to the filing of the Final Plat with Hennepin
County.

4. Park dedication fees shall be a combination of land dedication and cash. Any
cash feels shall be at the rate in effect at the time of filing the Final Plat with
Hennepin County.
5. An Assessment Agreement regarding the water tower located in Outlot A shall be
fully signed prior to recording the Final Plat.
6. Development standards for Blocks 1 and 2 shall comply with the standards of the
R-1 A section of the Zoning Ordinance.
7. Minimum wetland setback for single family lots shall be 25 feet.
8. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits.
9. The contract for Schmidt Lake Road shall be awarded prior to issuance of
building permits for Lots 24 through 30, Block 1 and Lots 1, 9, 10 and 15, Block
2.
10. A sign shall be placed at the entrance to the subdivision identifying the location of
Schmidt Lake Road. The sign shall comply with the conditions of City Policy 88-
494 regarding development signage showing arterial roads. A sign permit
application shall be approved prior to the issuance of building permits.
11. Perimeter screening shall include the use of six-foot fences as shown on the Sheet
2 (the landscaping plan).
12. A trail easement shall be provided in the vicinity of Lots 7 and 8, Block 1 and
recorded with the Final Plat.

44, 13. Drainage from approximately 13 additional acres of this site shall be directed
away from the Hollydale Golf Course, subject to Watershed District approval. The 13
acres are identified in an agreement between Weston Corporation and Hollydale Golf
Course dated May 1, 1995.

x-14. Standard Conditions:
A. Compliance with City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the owner's
expense.
C. No building permit shall be issued until a contract has been awarded
for sewer and water.
D. Street names shall comply with the City Street Naming System.
E. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new strictures on site adjacent to, or containing any
open storm water drainage facility.
F. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
G. Private driveway access shall be limited to internal public roads and
restricted from Vicksburg Lake and Schmidt Lake Road.
H. Final Plat mylars shall refer to RPUD 95-3.
L Appropriate legal documents regarding Homeowners Association
documents, covenants and restriction as approved by the City Attorney
shall be filed with the Final Plat.
J. Location and number of fire hydrants shall be approved by the Fire
Division.
K. Submission of a Site Improvement Performance Agreement prior to
issuance of building permits for perimeter landscaping and fencing.
L. All strictures on this site shall be removed prior to issuance of
building permits.
M. The developer shall install wetland monumentation delineating the
wetland within each lot. The monument design shall be approved by
the Community Development Department.
N. Appropriate legal documents regarding Homeowners Association
documents, covenants and restriction as approved by the City Attorney
shall be filed with the Final Plat. Specific reference shall be made to
the maintenance of common open space, fencing perimeter
landscaping, and the landscaping in street islands.
O. The Developer shall hold the City and its officers, employees, and
agents harmless from claims made by itself and third parties for
damages sustained or costs incurred resulting from plat approval and
development. The Developer shall indemnify the City and its officers,
employees, and agents for all costs, damages, or expenses which the
City may pay or incur in consequence of such claims, including
attorneys' fees.
P. Submittal of required utility and drainage easements as approved by
the City Engineer prior to filing the Final Plat.

regarding tree preservation.

R. The Development Contract, as approved by the City Council, shall be
fully executed prior to release of the Final Plat.
