RESOLUTION 2004-062
APPROVING A SITE PLAN AMENDMENT AND VARIANCES FOR HAMMEL,
GREEN AND ABRAHAMSON, INC., FOR THE SCHWAN' S FOOD COMPANY AT
2800 NIAGARA LANE NORTH (2003140)
WHEREAS, Hammel, Green and Abrahamson, Inc., is requesting approval of a site plan
amendment and variances for the Schwan's Food Company to be located at 2800 Niagara Lane
North, for property legally described as:
That part of Lot 2, Block 1, Circle Star Business Center 2"a Addition, lying Westerly of a line
drawn parallel with and 298.27 feet East of the West line of said Lot 2 (said distance measured at
a right angle to said West line of said Lot 2).
WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Hammel, Green and Abrahamson, Inc., for a site plan amendment and variances for the Schwan's
Food Company to be located at 2800 Niagara Lane North, subject to the following conditions:
1. A site plan amendment and variances are approved to allow for site improvements including
reconfiguring the existing parking to allow for delivery trick parking, constricting additional
parking spaces, and installing a fence and landscaping, in accordance with the plans received
by the City on December 18, 2003, and revised plans submitted on January 6, 2004, except as
amended by this resolution.
2. Variances to allow 1) outside storage of vehicles in a front yard; 2) a 6 -foot fence in the front
yard with a reduced front setback; and 3) a 5 -foot setback to the building from the drive aisle

are approved based upon the finding that the applicable variance standards as listed in Section
2 103 0. 03 of the Zoning Ordinance have been met.
3. Prior to issuance of a building permit, the applicant shall submit details for the final design of
the fence and security gate to staff to determine compliance with the Zoning Ordinance.
4. Prior to issuance of a building permit, the applicant shall provide a cross easement agreement
with the property owner to the north and east sides of property to ensure unobstructed
emergency access to the site.
5. Prior to issuance of a building permit, the applicant shall identify the location and materials of
any above ground fuel storage tanks, dispensers, and hazardous materials within 150 feet of
the site property lines.
6. Prior to issuance of a building permit, the applicant shall provide a financial guarantee and Site
Improvement Performance Agreement for all site improvements.
7. Sign permits are required before installation of any signage. All signage must comply with
Section 21155 of the Zoning Ordinance.
8. All roof -top and ground mounted mechanical equipment shall comply with the Section
21130.05 of the Zoning Ordinance.
9. The applicant shall comply with the City Engineer's Memorandum.
10. Approval shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project. The landowner or applicant may
apply for approval of an extension by the City, as regulated under Sections 21030.06 and
21045.09 of the Zoning Ordinance.
