HomeMy WebLinkAboutCity Council Resolution 2004-058CITY OF PLYMOUTH RESOLUTION NO. 2004-058 AUTHORIZING THE VACATION OF DRAINAGE EASEMENT FOR PONDING AS PLATTED WITHIN MALLARD POINTE WHEREAS, a petition was received to vacate all of the platted ponding easement within Mallard Pointe; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for January 27, 2004 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of January 27, 2004; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on January 27, 2004 to inform any and all interested parties relevant to the vacation of said ponding easement within Mallard Pointe; and WHEREAS, it was determined by the City Council that said easement is not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage easement for ponding purposes be vacated: All of the drainage easement for ponding purposes within Mallard Pointe.
