HomeMy WebLinkAboutCity Council Resolution 2004-056CITY OF PLYMOUTH RESOLUTION NO. 2004-056 AUTHORIZING THE VACATION OF DRAINAGE & UTILITY EASEMENTS WITHIN BLOCK 1 OF HUGHSTON ADDITION AND WITHIN THAT PART OF THE N1/2 OF THE SE 1/40F THE NEI/4, SECTION 18-118-22 WHEREAS, a petition was received to vacate certain drainage and utility easements in Hughston Addition and within Section 18-118-22; and WHEREAS, a public hearing with respect to said vacation was scheduled for January 27, 2004 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of January 27, 2004; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on January 27, 2004 to inform any and all interested parties relevant to the vacation of drainage and utility easements within Section 18-118-22 and in Hughston Addition; and WHEREAS, it was determined by the City Council that said easements are not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage and utility easements be vacated: DESCRIPTION OF PARCEL: Resolution No. 2004-056 Page 2 Block 1, Hughston Addition DESCRIPTION OF EASEMENT TO BE VACATED: The easements for utility purposes within Block 1, as dedicated in the plat of Hughston Addition. And DESCRIPTION OF PARCEL: That part of the North Half of Southeast Quarter of Northeast Quarter of Section 18, Township 118, Range 22, described as follows: Beginning at the intersection of the south boundary line of the North Half of the Southeast Quarter of Northeast Quarter of Section 18, Township 118, Range 22 and the southwesterly boundary line of new State Highway Number 55, thence northwesterly along said boundary line 231.25 feet; thence at an angle southwesterly to a point on east boundary line of Highway No. 101, 78.15 feet to a point 135.6 feet north of the intersection of the south boundary line of said North Half and the east boundary line of said Highway 101; thence south along highway line 135.6 feet; thence east to the point of beginning. AND Lots I and 2, Block 1, Hughston Addition, according to the recorded plat thereof. Hennepin County, Minnesota. DESCRIPTION OF EASEMENT TO BE VACATED: Said easement being the south 6.0 feet; the northeasterly 10.0 feet and the northwesterly 10.00 feet of the above described parcel. Also an easement for utility purposes over, under, and across the west 27.0 feet of the above described parcel. And DESCRIPTION OF PROPERTY: Lot 3, Block 1, Hughston Addition according to the recorded plat thereof. DESCRIPTION OF EASEMENT TO BE VACATED: A perpetual easement for public utility purposes over, under, across, and through the West 17 feet of the above described parcel.
