HomeMy WebLinkAboutCity Council Resolution 2004-042CITY OF PLYMOUTH RESOLUTION NO. 2004-042 ACCEPTANCE OF UTILITIES AND STREETS FOR CONTINUAL MAINTENANCE BASS CREEK BUSINESS PARK 4TH ADDITION (98097) WHEREAS, in accordance with the development contract dated August 18, 1998, Opus Northwest, L.L.C., developer of Bass Creek Business Park 4"' Addition (98097), has agreed to install certain improvements for said development; and WHEREAS, the developer has completed a portion of the street, utility and site grading as noted below; and WHEREAS, the developer has requested a reduction of the required financial guarantee to reflect the completed work; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA; that the financial guarantee requirements remain as follows: ITEM Street Constriction Sanitary Sewer Watermain Storm Sewer Boulevard and Drainage Swale Sod Pond Constriction Mitigation Pond Constriction N [_]RP Pond Constriction Street Signs (I x 200) Park and Trail Improvements Site Grading and Drainage Improvements Setting Iron Monuments Design, Administration, Inspection, As-Builts TOTAL ORIGINAL CURRENT NEW AMOUNT AMOUNT AMOUNT $ 73,700 $ 14,740 $ -0- 175,200 35,040 -0- 83,200 16,640 -0- 49,800 9,960 -0- 4,500 4,500 -0- -0- -0- -0- -0- -0- -0- -0- -0- -0- 200 -0- -0- -0- -0- -0- 573,500 344,100 344,100 1,500 1,500 -0- 115,392 51,178 41,292 $ 1,076,992 $ 477,658 $385,392 That the required financial guarantee for the above items be reduced as detailed above from $716,487 ($477,658 X 150%) to $578,088 ($385,392 X 150%) to reflect the completed work. Subdivision Bond No. 400JY 9719 may be reduced accordingly. RESOLUTION NO. 2004-042 BASS CREEK BUSINESS PARK 4TH ADDITION (98097) Page Two FURTHER BE IT RESOLVED that the financial guarantee requirements for the following items per Section 8.1 of the approved development contract remain as follows: ITEM Maintenance of Erosion and Sediment Control Plan, Street Sweeping, and Storm Sewer Cleaning Cash Cash in lieu of Letter of Credit ORIGINAL CURRENT NEW AMOUNT AMOUNT AMOUNT $ 1,000 $ 1,000 $ 1,000 $ 54,000 $ 54,000 $ 54,000 FURTHER BE IT RESOLVED that the street constriction is accepted for continual maintenance as of January 27, 2004, subject to the one-year guarantee by the Developer per Maintenance Bond No. SU9361 and the Maintenance Bond Extension Rider issued by St. Paul Fire and Marine Insurance Company. FURTHER BE IT RESOLVED that the sanitary sewer, watermain, and storm sewer constriction is accepted for continual maintenance of January 27, 2004, subject to the two-year guarantee by the Developer per Maintenance Bond No. SU9362 and the Maintenance Bond Extension Rider issued by St. Paul Fire and Marine Insurance Company. Adopted by the City Council on January 27, 2004.
