RESOLUTION NO. 2004-042
ACCEPTANCE OF UTILITIES AND STREETS FOR CONTINUAL MAINTENANCE
BASS CREEK BUSINESS PARK 4TH ADDITION (98097)
WHEREAS, in accordance with the development contract dated August 18, 1998, Opus Northwest, L.L.C.,
developer of Bass Creek Business Park 4"' Addition (98097), has agreed to install certain improvements for
said development; and
WHEREAS, the developer has completed a portion of the street, utility and site grading as noted below; and
WHEREAS, the developer has requested a reduction of the required financial guarantee to reflect the
completed work;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA; that the financial guarantee requirements remain as follows:

That the required financial guarantee for the above items be reduced as detailed above from $716,487
($477,658 X 150%) to $578,088 ($385,392 X 150%) to reflect the completed work. Subdivision Bond No.
400JY 9719 may be reduced accordingly.

FURTHER BE IT RESOLVED that the financial guarantee requirements for the following items per Section
8.1 of the approved development contract remain as follows:

FURTHER BE IT RESOLVED that the street constriction is accepted for continual maintenance as of
January 27, 2004, subject to the one-year guarantee by the Developer per Maintenance Bond No. SU9361
and the Maintenance Bond Extension Rider issued by St. Paul Fire and Marine Insurance Company.
FURTHER BE IT RESOLVED that the sanitary sewer, watermain, and storm sewer constriction is accepted
for continual maintenance of January 27, 2004, subject to the two-year guarantee by the Developer per
Maintenance Bond No. SU9362 and the Maintenance Bond Extension Rider issued by St. Paul Fire and
Marine Insurance Company.
Adopted by the City Council on January 27, 2004.
