HomeMy WebLinkAboutCity Council Resolution 2004-035CITY OF PLYMOUTH RESOLUTION 2004-035 APPROVING SITE PLAN AMENDMENT, INTERIM USE PERMIT AND CONDITIONAL USE PERMITS FOR BANNER ENGINEERING CORP. FOR A 48,000 SQUARE -FOOT RESEARCH AND DEVELOPMENT BUILDING FOR PROPERTY LOCATED AT 9714 10TH AVENUE NORTH (2003118) WHEREAS, Banner Engineering has requested approval of a site plan amendment, interim use permit, and conditional use permits for property legally described as follows; Parcel A: Lot 1, Block 1, BANNER ADDITION, Hennepin County, Minnesota. (TORRENS) Parcel B: The west 200 feet of the east 1097.5 feet of the south 435.6 feet of the northeast quarter of the northeast quarter of Section 36, Township 118, Range 22, subject to road. (ABSTRACT) Parcel C: The west 217.5 feet north 225 feet of the south 660.6 feet of the northeast quarter of the northeast quarter of Section 36, Township 118, Range 22, subject to road. (ABSTRACT) WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Banner Engineering Corp. for a site plan amendment, interim use permit and conditional use permits subject to the following conditions: Resolution No. 2004-035 2003118 Page 2 1. A site plan amendment is approved for a 48,000 square -foot research and development building, according to the plans and application received by the City on December 16, 2003, November 20, 2003 and October 23, 2003, except as amended by this resolution. 2. An interim use permit to allow reduced parking is approved to allow 354 parking spaces where the Ordinance would typically require 430 spaces, based on the findings that the applicable interim use standards as listed in Section 21020.03 of the Zoning Ordinance have been met, subject to the following conditions: a. The interim use permit shall expire at such time as the City documents parking shortages and the permit is rescinded by the City Council. b. Should the permit be rescinded, the applicant shall modify the site to incorporate additional parking stalls, compact parking or other techniques to add additional parking spaces in compliance with the Zoning Ordinance. 3. Conditional use permits are approved to allow 1) multiple principal buildings on one property and 2) a 48,000 square -foot building to be used entirely for office purposes in the I-2 district, based on the finding that the applicable conditional use standards as listed in Section 21015.02 of the Zoning Ordinance have been met. 4. A Transportation Demand Management (TDM) Program shall be submitted and approved prior to issuance of a certificate of occupancy for the proposed building. 5. Prior to the issuance of a building permit, the applicant shall revise the lighting plan to show compliance with the requirements of the Zoning Ordinance. 6. Prior to the issuance of a building permit, the applicant shall submit information documenting that all roof -top and other exterior mechanical equipment complies with the noise regulations as defined in City Code. 7. Signage for the site shall be in compliance with the Sign Ordinance. Separate sign permits shall be required. 8. Roof -top equipment shall be screened in compliance with the Zoning Ordinance. 9. Trash and recycling storage shall be in compliance with the Zoning Ordinance. 10. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. c. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. Resolution No. 2004-035 2003118 Page 3 d. Prior to the issuance of building permits, the applicant shall submit plans in compliance with the Ordinance regarding the location of post indicator valves, solenoid valves, fire department connection and lockbox, siamese connection, water mains, temporary water supply policy, site hydrants and fire lane signage. The street hydrants shall be located on the plans. The applicant shall include the fire lane constriction and fire hydrant detail on the plans. e. A monitored, automatic fire sprinkler system is required for the proposed building. f. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. g. No building permits shall be issued until the Site Improvement Performance Agreement has been executed and the required financial guarantees submitted. h. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21030.06 of the Zoning Ordinance.
